Insurance claim - dragging on
Discussion
I was involved in a RTC in March last year. Straight forward, third party failed to give way at a junction and t-boned me. Car a write off. Door cut off and required stitches in my head and had bruised/cracked ribs from the seat belt.
Third party have admitted fault straight away. Car has been paid out for. What is dragging on is the so called solicitors on my side! It's the company you'll see at sea...
It hasn't helped that my employer gave them the wrong information with my loss of earnings. But the case handler said she'll send the request off and didn't for a month. She then left and I got a new case handler...who didn't know he was now mine.
Is there anything I can do to speed them up? I phoned today and the bloke needs to have a look at the file. I'm going to phone back tomorrow afternoon once he's had a chance to.
Should have looked at the reviews before using them...

Do you need medical help? (genuinely?)
One option is to employ your own solicitor on a no win no fee basis- there are loads around!
At the time yeah. One option is to employ your own solicitor on a no win no fee basis- there are loads around!
Hole in my head from hitting my head on the b pillar.
I've already got a solicitor...linked to the sea captain insurance company. That's who im having problems with. I'm guessing I can't leave now as most of it is done.
I've had a offer from the other party. It was wrong with my loss of earnings (work saying they gave me full pay whilst I was off, I didn't ). Solicitors said they'll contact work again and get it sorted. They didn't for nearly two months. Chased them up and it hadn't been sent.
Just slow at doing everything.
The third party have given an offer, which is close to what I was expecting for injuries. It's just the loss of earnings I need to get them to sort out.
Hardly dragging on. I was 3rd to front in a 6-car shunt years ago. The back guy claimed the 5th guy caused it, and he just hit him. The 5th guy insisted he stopped and the 6th guy caused it. After 22 months, my insurance company took the back guy to court. He admitted liability out of court. Now that’s dragging it out.
That’s nothing! My girlfriend got t-boned by a Dutch HGV on a roundabout in June 2017. Luckily no injuries but her mazda2 was a write off. As a foreign 3rd party she went through her own insurance. Car written off, girlfriend payed out (minus excess) new car purchased etc etc. Took until April 2018 to get her excess back and didn’t get her no claims back until January 2019!
Part of it was the 3rd party were arguing about whether the car should have been written off (the car was worth 2.5k and needed a door, rear quarter and maybe a B pillar so not worth repairing) This was 8-9 months after it was written off, payed out and the car sold at salvage! What they were playing at I don’t know.

I dealt with one like that, 6 cars involved, the 5 big cars at the front all blamed the one behind, till the last in the queue got blamed-it was a 1960's Mini with a mild ding in the bumper! But I guess thats a LOT of force that went through that ding
As for OP,ask for a payment of the PI damages, and argue the wages later

I was under the impression in these situations everyone claims off the actual car that hit them, not the one right at the back....?
Agree, first in line claims against second, who then claims against third etc right up to fifth claiming against sixth, who has no one to claim against, assuming everyone sustained damage of course.

Dragging on for something so simple to sort out though. Anyway...update.
Been given a offer. Happy to accept it. Should get it all done within ten working days.

A car in front of me stopped suddenly once. I slammed my brakes on in time and stopped with a couple of feet to spare. The car behind me wasn't so quick to react, ruined the back of my car and shunted me into the car in front. Mine was written off.
If the car in front claimed against me, my insurers claimed the entire cost back from the car behind. He probably got away with it too because the car behind him didn't stop either (I felt the second collision 2-3 seconds after the first). It went down as a non-fault claim on my history.

I don't know about the fault/non-fault bit but AIUI your insurance would have paid the driver you hit. NO idea whether they would look to claim that all back from the guy that hit you though. I would imagine not as that could get very messy with who felt what impact and when and trying to prove it all.If the car in front claimed against me, my insurers claimed the entire cost back from the car behind. If a driver is pushed into the car in front, he hasn't been negligent. I was the leading car in a similar situation and we claimed directly from the last car that caused the shunt.
My friend has been in the same situation, but he was in the middle. The Insurer of the car at the back tried to claim that my friend had already hit the car in front, and only wanted to pay for the rear damage.
The lead driver stated that he only felt a single impact, so the driver at the back got the bill for all the damage to both cars.
