Is this legal?

I'm sure I was flashed this morning on the m62 by the speed camera linked to the smart motorway.

It was just after 6 and there was little traffic so everything flowing fine. I'm certain the speed signs on the gantry before were 60 and the signs on the gantry after were definitely 60 but if I was flashed then it means the gantry with the speed camera was set to 50 because I was definitely under 60 at the time.

Are they allowed to do that? There was no reason for any speed limit other than NSL to be in place at that time anyway.

That's ok then. If you get a ticket in the post, go to court and use that as a defence. You'll be fine.

3 gantrys, 300 yards apart. Straight stretch of motorway with no junctions inbetween

1st 60mph
2nd 50mph
3rd 60mph

2nd one happens to have a camera on it. No one can tell me that's anything but an attempt to generate money and shouldn't be allowed

Not absolutely sure what you mean here.

Are you saying gantries were all showing 60 but there was another gantry in the middle without a speed limit display which had cameras on it set to lower than the limit indicated?

Or do you mean there was a gantry with a different limit displayed but you didn't look to see what the limit was?

IIRC ghertie told us they test flash when the limit changes or something like that.

OP, you'll just have to wait and see what comes through. Would be annoying, but nothing to be done about it.

They have cameras that record you going through the speed limit and subsequently getting flashed as evidence of the speed showing on the overhead. Therefore if it was a mistake by the camera then you'll be fine anyway - if it was showing 50 on the overhead and you went through at 60 then you were speeding and should have been paying attention.

You won't get done for anything you didn't do.

Don't these have a camera to show exactly what speed the gantry was showing at the time of the flash? I suppose it could have a time stamp on when the gantry was instructed to change but there's no guarantee that it wouldn't replicate a technical error.
