Insurance issue

My son purchased a flat and moved in 2 weeks ago. Despite repeated attempts to contact the factor ( on holiday until end Nov ) to pay factor fee and Buildings insurance he has still not made contact.
2 days ago he noticed water leaking from the flat above - the Tennant above denied that he had a leak even when we pointed out that the water was coming from where his sink / washing machine was. It took 24hrs to locate Tennant and in the end we had to call out a plumber at our expense.
What he found was the cold water connection to the washing machine was loose and wrapped with kitchen roll + obvious signs of water escaping.
Now the landlord upstairs is saying its our problem and we don't have insurance. Not sure how to proceed.

Speak to Landlord I would say morally he is responsible.

Statement from tenant and signed
Landlord was very nice and polite but basically said claim on our insurance that we are not sure we have. He wouldn't pay
the plumber to fix the leak in his flat
Thanks for the replies. Waiting for a call back but it should get sorted at no cost. The factor was the company that built the flats and still owns quite a few that he rents out. They have a good local reputation and have said they will deal with the landlord upstairs.
This was a leak that took 48hrs to stop so a lot of damage inc a ruined kitchen. All because the landlord and Tennant upstairs denied there was any sign of water.
