Hopefully a simple one.
New phone from online retailer, (Sony on Vodaphone)
Issue with gallery app restoring deleted images every time they are deleted or not allowing them to be deleted.
Online retailer fobbing me off to Sony who say it's not their issue.
Surely the contract of sale was with retailer so they have to fix any issue for me without me chasing around manufacturers ?

Sony actually told me the software was a third party issue (google android) and that the retailer had sold me the software.
Why would the retailer not be liable for the whole package anyway ? they sold me the phone and the software on it, no ?
Seems like someone is trying to wash there hands.
It appears to me that the app is syncing from somewhere but I've no idea where, but maybe not as it doesn't actually delete the picture even as you select delete. It just stays there.

The Consumer Rights Act says that goods need to be "fit for purpose" but I think you would be hard pushed to argue that a problem with a single app on a smartphone breaches that test.
It really should be Vodafone that help you though. Is the gallery app a standard Google Android one or one Sony have added? If you turn off all data does it still restore back? It's almost certainly a setting somewhere you need to change. Are you able to remove the app completely? There are dozens of gallery type apps on Android.

Every sync is turned off that may retrieve the pictures. They do not even delete, never mind come back ! lol.
Sony have tried to sort it and seemingly it's a popular issue on the Sony forums but no one has managed to find a fix.
Vodafone are calling later. Retailer caved and asked for phone back fully unlocked and reset to factory settings which quite frankly is making me wonder whether to just live with it for 18 months then bin the feking thing and go back to Samsung.
