you can hold your phone and film whilst driving, its only illegal to use it for a function that uses data
You can use your phone if you're not causing an obstruction and have the engine off. I'd suggest that the place the ARV had pulled over was causing an obstruction, though not a major one.
I suspect if a normal X5 did that that and a traffic cop saw it they'd get a ticket.
That said, the guy filming it is a bit of an arse about it all, I'm happy to cut some slack to the Police given the s**t they have to deal with on a daily basis.

Plenty of occasions on youtube where cyclists have recorded people in traffic on their phones and they've reported it to the met and points and a fine are dished out.
Don't see why the police shouldn't be held to account for what a laymen would get shafted for, that car must have bluetooth and if not why can't the passenger deal with it.

No comparison, the interest is what the officer is advising on use of a mobile phone for the public. Stating it’s legal to use while in traffic.Not sure why any comparison is being made

There is a specific exemption from speed limits for police vehicles, is there one for phone use?Police Officers have a very hard and stressful job, sometimes life threatening and it is clear that they have to deal with issues which may arise at inconvenient times.
This is not justification for breaking laws, but it is well known that power corrupts.
Playing on your perceived ‘power’ is what has kept PA out of a cell - not that using a phone is akin to peadophilia but the assumption that “I’m important enough to do as I please” is common to both PA and to the officer shown in the recording.
