Hello,
the wife has received a demand for £170 through the post from Debt Recovery Service, it's only just arrived as address on log book hadn't been changed yet from when we moved house a year ago. The fine is on behalf of smart parking, for a shopping centre car park, it's claimed 2.5 months ago the car was parked, I assume went over time as it doesn't say by how much etc and we can't remember who was driving that long back.
As log book is still registered at old address this is the first we've heard of it, looking online, advice is to not communicate with DRS at all, they just keep sending threatening letters etc.
Should we take this up with smart parking asking to provide proof of how much over time and to identify who was driving etc? or should we just ignore as it's unlikely to go any further? I'm not paying £170 for car being parked too long if that's the case!

If it were me and the letter was addressed to a former address I’d be inclined to ignore it.

Any original letters must have been sent to old address, new one however has been sent here.

Doesn't matter who was driving they have a vehicle with a plate registered to your wife failing to comply with the terms under which the car park was used. I bet the fine was small but the majority of what they want now includes their fees for escalating beyond providing the opportunity to pony up months ago.

They might go away or they might take you to court if you ignore it, either way the amount they want will only increase if you don't engage with them and they continue to pursue the Mrs

Failing to notify DVLA of new address may be a bigger issue.
The DVLA may even have written about your driving licence, and with no reply, may have revoked it!

Don't understand how anybody can leave it a year to change an address.

Doubt that excuse will go down well with however you end up talking to about it.

If it hasn't been changed for over a year, how did you get the roadfund for it?

Driving licences were changed, logbook forgotten about due to having a difficult year and not being at forefront of mind.
Tax is on direct debit so automatically goes out.

old house owner still had DVLA mail after 3 years and i kept telling them by email and they kept coming to collect it - some people just want to watch the world burn

Its not a fine btw,i think the more popular and appropriate term is 'speculative invoice'
I got a parking charge notice slapped on my windscreen from a private parking company last august,for parking in a supermarket car park without paying.
I just pulled it off the windscreen,crumpled it up and binned it.
I received a couple of letters from them over the next couple of months but just binned them without opening them and I did not communicate with them whatsoever,and haven't heard anything from them since.
Same thing happened with my motorbike a few years back as well
Having no communication with them is the thing that frustrates and impedes them the most.

Just out of interest did you pay for your goods in the shop or just go through the self serve till and not pay ?
How do you decide which services to pay for?
If you get a beer in a bar do you just walk off without paying like you did with the car park charge ?
Maybe that's why the BIB cba doing anything about low value shoplifting now according to various reports.

and the same supermarket in my home town doesn't charge for parking

Sounds like you made a mistake but I don’t see why that should cost you £170.

Just beware OP, IF they do take it to court, and the court agree with them however unlikely, you get a CCJ. This then restricts your ability to get loans, mortgages and any other type of credit to the sort of rates/products that cost way more than £170 extra to service.

If it were me, I couldn’t leave it to chance, I’d contact them, have a row, and if I couldn’t get out of it, try to negotiate and settle before it got worse

Fair enough you didn't pay for parking as you weren't paying attention when you parked so you were 'legitimately' ticketed and still decided not to pay. Fair enough.
Even better you went in and used/abused the supermarket car park without patronising their store.
Maybe there's a valid reason they charge at one store and not the other and you are part of that reason ?
It was a valid question.

A County Court judgment only appears as a negative credit hit if you do not pay the sum ordered.
