67 in a 50 (smart motorway)

Today on the M62 towards Leeds I think I’ve been caught out.

I was driving along and heard the sat nav alert me of an incoming speed camera, I was travelling at what I thought at the time was under the speed limit at 67mph, I didn’t notice any change of speed limit

The very next gantry (maybe 5-700 yards) I noticed it displayed “50”, as did the gantry after that then finally the National speed limit.

feeling anxious I decided to come off the next junction and go back, the gantry + camera in question did indeed say 50mph although for all i know it could have changed in the meantime, I usually “notice” the limits

Question is, will this be a 4-6 point slam dunk or is it possible I could get a fixed penalty of £100/3 points?

This will be my first ever offence of over 10 years of driving, the job I’ve just been offered specified a clean licence

Yeah I’ve seen that chart, however I’ve seen many threads on here with people who appear to be in the b band but get the 3 points.

Doesn’t appear to be a consistent punishment

So the question is - were you actually doing 67 mph or is that just what your speedo said? Most if not all speedometers over-read by 3-5mph at 70mph, so if your speedometer said you were doing 67 then it's possible you were actually doing 64 or less. Which means it's possible you could be eligible for an online speed awareness course, which would mean you would avoid points and keep your licence clean.

Ignore “b band” nonsense you’ve seen on the internet. That’s for court proceedings. Your case won’t involve court proceedings so focus on the chart above. There’s no inconsistency if you understand the process.

67 on sat nav, had the car set to cruise at 70mph

If it's any help, I got caught doing 72 or 73 (can't remember which) in a 50 motorway zone a year and a bit back. Was 3 points and £100 fine.

There is a period of grace when the mandatory limit is changed, so it won't flash if the gantry changes to 50 as you drive under it and for about 30-40 seconds after, so you may be Ok. 14 days to wait and find out . . .

I've been flashed twice by a gantry camera, once as a driver, once as a passenger, neither time anything arrived, both times it was accidental (should say careless) as the limit had changed and we hadn't noticed.
