Fine for being on your phone but police didn’t stop my mate.

So a mate got blue lights and police pulled up beside him and said you where on your phone you’ll get a fine threw the post and then drove off. They didn’t stop him they only stopped next to him at the lights to say “you’ll get a ticket in the post”

What’s the chances they won’t send the five ?

It's possible. I've done it in the past before when I my way to court and didn't have time to stop them etc.

Did they ascertain his name and address, without this all they can do is send the registered keeper a request to name the driver. So as of now no fines, no points.

It depends.

I've reported someone at the roadside for the offence and didn't have my ticket book at the time. No paperwork to give at the time. Back at the station it's fill some stuff on the PC, send my statement to the ticket office and they'll send out the paperwork (in this case he was able to do a course for the offence ).

Others I've sent a NIP requesting the drivers details and dealt with it that way (same as if are speeding past a camera van for example).

I think the car is registered in his name so he’s easy find.
I guess he will have to wait and see what comes in the post.

Whilst we are on the subject, what’s the situation if you’re using your phone as a sat-nav, it’s in a windscreen holder and you touch the screen for a change of route, (for example)?

I think (though I'm happy to be corrected) that if the phone is mounted in a windscreen mount, it's OK. AIUI it's using the phone while it's held in your hand that is the problem.

Fine if it's in a holder. Long as your driving isn't effected by using it. Then it could be due care or driving whilst not in proper control.
