Warning!! Dad's Army speed trap that's legal North Essex

My wife has just had a notice of intended prosecution for 37 in a 30 in Tendring village.
There is a straight road that leads away from the Village that on the offside is pavement but the nearside is a banked grass verge interspersed with large bushes!
The civilian speed trap was secreted behind one of these large bushes with a table perched on top of the verge so we're invisible till you passed them?
The annoying thing I had seen them in my rear mirror the day before but only doing 25 so ok.
The following day my wife was driving our Fiat doblo with our disable son on board and as I had warned about them said she took extra care not to speed!
I explained all this in a letter to the Essex speed authority but to no avail!
Here is the Kicker , A group of pensioners in Harwich have been given the special dispensation for their evidence to be used in court!!
The only one in the country!!
By the way guys is it legal for the to conceal themselves as every proper speed officer I have seen has been in plain sight!??

I thought they send warning letters and only prosecute people who keep doing it.

She was caught, she is liable to be fined. End of, surely? Why does taking extra care not to speed(!) driving a Fiat Doblo with your son aboard change anything?

1) She didn't take extra care not to speed, she was doing 37 in a 30, which was likely closer to 40 on her speedometer.
2) You explained to the speed authority that you had a disabled son in the vehicle, and that didn't absolve her from speeding? Shocker!

No, she wasn't, as she was doing 37MPH. Throw all the excuses out that you like, but the inability to read where 30MPH is on your speedometer isn't going to cut it.Not quite sure why you think a few feet of elevation is going to make a difference to the instrument's ability to read an object's speed.

Maybe the article is poorly worded (or inaccurate) but, if true, this would concern me far more than an alleged 37mph in a 30mph limit.Wedge. Thin end of.

Does the grass verge have some impact on the readings that a pavement doesnt?I would argue that being less visible will give more accurate readings than being visible from half a mile away, as if people dont see you until its too late, then people will drive the same as they always do, which would suggest that you wife regularly travels in excess of the speed limit with your disabled son in the car.

As already mentioned, the offence happened and is not disputed, so take the speed awareness course and be bloody grateful it's not points and a fine. If she can't read the speedometer then expect many more of these.
It is really quite simple, don't speed in a 20 or 30 limit, as they are there for a reason and so are likely to be policed. Regardless of who is doing the policing, you only have yourself (or your wife) to blame.
I'm also not sure why driving with a disabled child in the car is in any way a mitigation? Surely it's quite the opposite?
