LPA Question

My MIL is ill in hospital and there are some bills coming in that need sorting.

My wife, BIL and cousin all have LPA ( unsure if Joint or Joint Several ) for both finances and welfare


We are going to speak to the Solicitor at some stage but if we invoke/use LPA does this prohibit MIL from controlling her finances if she's able during her recovery or would we need to speak to the individual banks etc to see how they deal with it?

Do you have the full original document signed by the OPG? It is about 30 pages long. It will tell you if you can use the LPA individually or jointly. If jointly it will be a bit of a pain. If you do decide to use it the bank will need to see the original or a certified copy. Once you have used it, it does not stop your MIL retaining full control of her affairs. The OPG are very helpful if you speak to them. I hope that helps.

Thanks for the reply, yes after confirming this avo that the solicitor doesn’t hold the document we found it in her house (and copies) thankfully it’s a joint several so we can act individually.
