Had a RTC last year, 3rd party admitted fault through their insurer without any problem, car written off, payout etc all sorted.

Now I've received a call from a "Total Motor Assist" to say that there are money set aside to pay for my "discomfort" due to the collision, and it's mine if I claim it. I said I'm not injured at all but they said that it's just the discomfort since that I must have felt the collision. Is this legit?

They have details such as the date of the RTC, my reg number, my name etc...

I would automatically assume that TMA ask for compensayshun for injury, insurers pay out as below "worth fighting" levels, and you get 25% of that. But I'm cynical.

No, it's not legit. You weren't injured, so you have nothing to claim. What they mean by "discomfort" is a fictitious injury claim, that they will make on your behalf, and keep the vast majority of what's awarded to you thru outrageous Ts & Cs within their 400 page contract that they know you won't read before signing.

Tell them to fking well fk off, the fking scamming fkers.

I had a fault claim against me once.

There was no damage to the other vehicle (I know it sounds odd) and hence no claim for that. But my insurance sent me a copy of her claim - lots of questions on a form about whether she'd gone to hospital (she did), and lots of questions about her injury, whether she needed any treatment, whether there was any ongoing problem etc. - all of which she'd answered "no" to.

At the end of the form (of many pages) - she claimed for some kind of mental trauma. She was - apparently - scared to leave her house now.........

These days, we're not supposed to question people's mental health so maybe it was true....... I've no doubt my insurer paid

I can understand why people go for these things - daughter's perfect car being written off was a chunky amount of dismay, hassle and inconvenience. A grand to cover that, not to mention a valuation at the very bottom edge of what was acceptable, would have been very welcome.

Why not just claim it? What harm can it do, if someone wants to give you money take it!

A lot. Claiming money under false pretenses is illegal and could get you locked up.

Perhaps he'd like to send us all a few ££££ to help offset our increasing insurance premiums resulting from these spurious claims.

Just bypass the middle man and send him some money yourself.

After all in the end we all pay for it...so take one for the team.

With the greatest of respect, you've said you weren't injured, so why would you think you'd be entitled to money (legitimately) for something that didn't happen?

It ultimately comes down to your scruples at the end of the day. You could engage them and be forever one of those scummers who contribute to everyones increased insurance costs, or you could just tell them to do one.

I had an accident just over a couple of years ago, and was plagued by these calls last year - like you with them knowing the particulars of the accident. Like you they insisted on telling me that I was entitled to claim for injury, even though I wasn't. As far as I'm concerned these companies and the people who knowingly do their bidding are scum.

I was pestered for months when one of my cars was backed into on my drive - whilst I was still asleep in bed.

Even when I explained the physical distance between myself and the car, I was still asked 'Are you sure you don't have a hidden injury etc?'

Used to work in transportation, a friend was visiting a bus co in the US and they are used to people rushing to board a bus that has been in an accident so they can claim for fictitious injuries like these.

It is fraud and puts all our insurance premiums up. Insurance companies will always make a profit out of us, they are not charities.

Still you have reported it on a public forum so what harm can come of making the claim . . . .

Actually, in motor insurance, much of the time they don't make a profit. For many it's a loss leader, but they hope to sell you other products that do make a profit, and for some they have so much invested into it, they are just hanging on hoping for the tide to turn (20/21 with Covid will have meant profits will be assured for all).

But motor insurance runs at a loss for many insurers.

Where is there fraud involved, there is no dishonesty refered to in the OP post at all!

If the OP were to proceed, sooner rather than later he will be asked to sign off on a statement claiming fictitious injuries. At that point it would become fraud.

It's kind of smoke and mirrors though..

I like to think that they take my money and 10000s of other people's money and that they just break even.

Statistically if they break even the average point of the claim will be right in the middle of the year we paid for. They will take another month to.pay out. So

Even if every penny they take in premium.is eventually paid out, and no more or less. They've still had all that money for 7 months on average.

I'd like to think they employ people to invest that money and make a profit from it ?
They could even make a loss on the insurance, as long as they make enough of a return on thier investment of it.
