Rear Ended by bike...now he’s got a made up witness!

I’ll keep this short...

Got rear ended by a courier bike 3 weeks ago....insurance have paid out in my favour. However, I’ve just received a very official letter from the Surrey police alleging that I could be guilty of driving without due care and attention. I have spoken a very nice guy at Surrey police that issued the letter and he says the bike rider has a witness to saying I knocked him off...(he didn’t have a witness!)

Luckily,I also had a witness who I have just spoken too who will back me to the hilt. She also has....wait for it....dash cam footage!!!! RESULT!

What I want to ask now is...What happens to the little scroat who has dreamed up the imaginary witness potentially putting my career in jeopardy (I drive for a living)?

Is it a courier company? Or a self employed guy? Can you trace any shirt logo or anything?

Unless he actually can back up his claim, I can't see how he's even "potentially" putting anything in jeopardy. You're not about to be convicted of anything on an unsubstantiated statement, are you?

100% this, we pay enough for insurance with all these scammers around.

Fight it with dashcam footage and even push for defamation and / or fraud as a counter accusation.

What happened in the incident, just because the insurance sides with you, doesnt mean you couldnt be charged with something by the police.

I was stationary, got rear ended waiting for the car infront to turn right. He went in the back of me....simples!

Doesnt get more simple than that lol, I cant imagine the police will do anything to the other driver tbh, lack of resource.

Plus with damage on rear of car, the only avenue he has to make something up is say you reversed into him.

Secure that footage and play your cards right to drop the fool in it.

If you’ve a witness with footage then clearly you’ll be fine.

If it hasn’t already occurred to you then, given that you drive for a living, I’d suggest that it would be a good idea for you to have your own dashcam, front and back.

Just received the footage...would love to post it now but better not....it’s conclusive!

So....now I’ve got it what’s my next plan of action?

How do I play it... he and his legal team don’t know I’ve got footage...I’d like to give him a taste of the anxiety he has given me all day and to show him that he can’t make up witnesses to cover his stupidity! I’m not normally the kind of guy who wants revenge....but I’d like to make him suffer a bit!

Are you under an obligation to 'declare' the footage as soon as practicable, or can you string it out and 'pull it out of a hat' later?

Good question...I don’t know exactly what he said I did although I ‘think’ he is saying I knocked him off his bike! I haven’t been told that I have to declare the footage. It won’t go to court that’s for sure. I just want him to get a stty letter telling him that he’s been a fkwit!

I'm not a legal bod, but could you not ask for a copy of the witness' statement to see what it says?

Then presumably a response with a copy of the dash cam footage saying that it's all obviously made up would perhaps see the end of it

I'll second the suggestion that professional drivers should invest in a dashcam.

In my experience, the only downside is that you tend to driver slower.
