Bit of a long story here, so please bare with me....

Around Feb this year I decided to look for a new car, a C63S and eventually got into the knitty gritty of haggling over the price/valuation of my old car for a new C63S night edition premium in blue, when the deal was agreed I paid a deposit (£1000) but an hour later the dealer phoned all apologetic to say that car had been sold from under my nose...

Jump forward a week later as I pulled the trigger on a black C63S night edition premium plus with the same dealer, at an uplift in cost being a higher specification (couple of £K).

I took delivery of the car on 26/3 , all of this was done under lockdown if that matters, it was bought remotely etc. After a few days I couldn't get the park assist (Parktronic to work), I'd watched numerous YouTube videos, gone through the manual etc etc and reported an issue to the supplying dealer on the 31/3 (5 days after delivery).

We've been back and two for weeks trying to resolve this, them sending videos, me sending them videos. I'd also sent them some information relating to a new legislation that was coming into force on 1/4 regarding autonomous parking whereby certain vehicles would have this functionality disabled by the manufacturer because the sensors were not good enough/meet the latest regs - you guessing it the C Class falls into this bracket. The dealer assured me this was not the case and as my car was supplied prior to 1/4 it should not be affected by this. Next they offered to book the car in with my local dealer for them to investigate. The car went into the local dealer last Thursday 6/5 and they could not find resolve the issue and were left scratching their heads. They did however supply a print out of the build/installed software and features... one of which is: -

8B8 Active park assist reduction (UN R79)

Which relates to exactly what I feared.

I've since raised this with the supplying dealer and explained my car was specc'd with park assist (code below), but I don't have this feature as it's been disabled, so I've paid for something that I haven't received and to compound this if I had managed to buy the original car it wouldn't have had this feature anyway and be cheaper.

I've then informed the dealer that I would unfortunately be rejecting the car on principle or maybe we can reach an agreement on £££ refunded.

Today I've received an apology pointing me towards the updated brochure from Sept 2020 where this has been discontinued... but my build sheet states active park assist...

What should I do, what would you do?

You have paid for an extra that doesn't function, therefore should be refunded for the cost of that.

All this talk of rejection doesn't help IMO. You're using it as a stick to beat them with, but instead focus on getting money back for something you haven't paid for.

Keep it realistic. If Park Assist is a £500 option, you want £500 back.

I think a letter would be my first step rather than engaging anyone else

You ordered one thing , the specification changed and they failed to inform you, dunno if you do have grounds for rejection but what do you really want ?

So simple letter

Dear Sir

Back in XXXX I ordered this car (Build sheet attached)

Since delivery I have discovered that XXx feature is not included

This feature is very important to me hence why I ordered that specification in the first place

I would like to reject the car /or would be willing to discuss compensation commensurate with the lack of this feature

Thanks so far, everyone looks to be on the same page.

The last thing I really want to do is reject the car, it's a great car... but it's the principle isn't it?

What do you want ? bare in mind options don't always hold value so if its a used car it may make it more desirable but not worth more, obviously if your buying new and you have paid for something taht isn't present then its either a refund on what the option cost or reject if you purchased it for that specific option.

If they called and said we will give you £250 would you accept it ? Or are you hoping for £2500 back for something that would have only cost £500 as an option? Are you still trying to compare the current car to the one you originally wanted that was a few ££ cheaper ?

The dealers will fight you over a rejection, you want a quick and amicable settlement, so work with them rather than against them. Make it clear that the option you selected and paid for does not in fact work/exist and that you'd like some money back as others suggest. Rather than cash, try suggesting that they offer you a good deal on a service plan / extended warranty or something like that. They're generally much happier to supply a service at a discounted rate to keep a customer happy rather than make a refund.

And the Parking Assist isn't good to be honest, I gave up using mine..

I have no real opinion on the question. But for gods sake don't do anything for the sake of a principle unless you have infinite time and a similar amount of money.

Decide what you actually want to achieve and stick to that.

I don't think the OP is getting his knickers in a twist, he's stated he likes the car.

He said in his OP that he had told the dealer he was "rejecting the car on principal"...

Then rejecting it, or feigning an intention to reject it, is not the answer.

What does OP want? Realistically, the "loss" is the value / cost of the feature which wasn't delivered, and that is about all. Getting that value refunded seems entirely appropriate, but rejection, not so much.

I've never been in a car where this works well and you never use it even if it is enabled. Some money back for the feature you paid for should be a fair compromise.

My considerably older w204 has the guidance but manual control and f me it is entirely laughable. If you followed it you'd end up scraping your rims and killing your neighbour.

I would 100% chase them up constantly about it. It worked for me
Bought a new car, dealer said it would come with lane position assist (self driving on a motorway thing) and the and didnt come with it
managed to fight with the dealer, put 10k miles on it and got another brand new one at no extra costs biggrin

This is a joke right? Or buyers remorse?

Isn't park assist a standard feature on all higher end Merc since approx 2014? I don't believe it is part of the option packs, or a stand alone option. I may be mistaken.

Either way, it's pointless, it won't be used and is certainly not grounds for rejecting a car. They won't refund you either.

So if you'd paid extra for an option (which the OP says he has) and it was de-activated before you even got the car and can't be used, you'd be happy just getting on with your life and not pushing for a refund for that option amount?

If you spec'd a sunroof and turned up with a roof you couldn't open, you wouldn't kick up a bit of a stink?

You're a salesman's dream aren't you?

Sounds like you ordered the car at the same time as a spec change/adjustment was coming; the first order being the original spec with the auto park assist function being standard and then the 2nd order being the revised spec without this function as standard and not available as an option, is that right?

If the base cost of the car is the same with and without this function then I think you will struggle to get anything out of the dealer, threatening rejection just seems like cutting your nose off to spite your face as it would seem that any replacement is unlikely to have the function.

Regardless these auto parking things are crap, generally it is used once or twice to show friends and family and then never used again as it is so slow and clunky.
