Raises my curiosity antennae, is the misconduct in a public office reserved for those voted in rather than employed? I'll check back on this but off to google it is.

However
The elements of the offence are summarised in Attorney General's Reference No 3 of 2003 [2004] EWCA Crim 868.

The offence is committed when:

a public officer acting as such;
wilfully neglects to perform his duty and/or wilfully misconducts himself;
to such a degree as to amount to an abuse of the public's trust in the office holder;
without reasonable excuse or justification.
And constables are specifically stated to be in public office, so why not?

If you pay a Covid fine within 28days, you won't get a criminal record........so not misconduct in a public office. However, unlike Joe Blogs, the Officers will face an internal conduct hearing.

There was a report yesterday of an off duty cop being photographed at the Rangers FC celebrations. He's already been fined for breaching COVID rules, and is now facing disciplinary action, with the potential of being sacked. Given the First Minister's "absolute disgust" at the behaviour of the fans at the event, there's the potential for a "political" decision of the guy's future.

Yes, they probably all sit around the desk together drinking tea and eating doughnuts at shift briefing time, but could not do the same in one of their own homes.
