V5C - unauthorised changed of keeper
Discussion
Hi All,
I've been on the forum some time but have never felt the need to post up until now.
I split with my partner a while back and have recently been trying to get on top of all the various things one has to do when there is a break up of a long term relationship and a change of address. My ex was quite abusive, physically, financially, as well as controlling in other ways, such as opening my mail, separating me from my family and such.
Upon our separation I retained the V5 for a vehicle that they had the day to day use of prior to our break up, although I had paid for it. Whilst I was the registered keeper I would admittedly describe my ex as the owner as they taxed/MOT'd and insured it. I would have no problems filling out the new keeper section of this document and handing the vehicle over to them. Both our respective vehicles would be considered assets to be split upon divorce anyway.
However, upon going on to the DVLA website I saw that their records indicated that a new V5 had been issued a few months prior. I had not taken any action to transfer the name of the registered keeper and still retain a full V5 doc with new keeper slip, albeit with my old address on.
I have submitted a subject access request to the DVLA to get to the bottom of this new V5 issue date, but they have replied stating that I am not the registered keeper and will therefore not share any information with me.
As I've stated above, I would be willing to hand over the vehicle but what I have issue with is that it would seem that my mail has been opened and a legal document has been falsely signed in my name.
I reported the above to my local police force as to my understanding there are offences committed here. S45 of the Vehicle Excise & Registration Act 1994 and Section 84 of the Postal Service Act 2000 would seem to cover the above allegations respectively.
The police were completely disinterested and I can understand to a degree as I stated I would have handed over ownership of the vehicle to my ex but I'm quite uncomfortable with the fact that my personal correspondence was opened and my signature was forged. Notwithstanding the fact I would have handed over the car, is this fair in your opinion?
I'd be grateful if any forum members could share their thoughts on the matter. Is it best just to let it go, as like I've mentioned the vehicles will be seen as assets? Or should I push the matter either with the police or DVLA?
Thanks for any advice

I think it's more likely they requested a new one without intercepting any mail. There's nothing the DVLA would send you that they would need to do it?

It does sound underhand but you say they tax the vehicle so they may have done it to get a V5C to retax it.
Recommend putting in a request to the post office to have your mail redirected to your new address.
Did you pay for the car? They did? Or jointly?
If you are the owner then don't ask the DVLA for a data access request, inform them the V5C has been changed without your knowledge and that you are the owner.

thanks for the reply. I've since got my mail re-directed. I paid for the car but in all honesty would consider it a joint asset as it was used to take the kids to school etc.
They only had to ask and I would have taxed the vehicle or signed the vehicle over. As I say, it's not so much the ownership of the vehicle it's more that I've had my mail accessed, a legal document signed in my name and the police response.
I'm just seeking advice on whether I should just accept this in terms of the police response and take it as a learning experience as to how easy it is to change over the registered keeper
If you look at the V62 form they could complete that to have a new V5C issued without opening your mail or forging your signature. They don't have to put any details about you on there and could say its unavailable due to relationship breaking down in the other box and therefore not committed any fraud in that regard.
I agree they should have just asked, but sounds like communication has broken down.
You may be jumping to conclusions about the mail opening, but should take precautions by ensuring all your important things are up to date with new address (bank/ISA/insurance/job/mortgage/credit cards etc).
I think in your best interest to either a) just ask partner why they changed it without asking, or b) leave it be unless possession of the car is something you wish for.

The UK need a overall of these law's
It's about the time the legal owner and registered keepere had to be the same but with another section adding for if the cars a lease/loan car to put in whoever is using the vechile long term
That makes no sense. Keeper is just the person responsible for the car. The owner is a different legal status so why try to make them one and the same, then add a section for exceptions. They are two different things so keep them seperate. It's about the time the legal owner and registered keepere had to be the same but with another section adding for if the cars a lease/loan car to put in whoever is using the vechile long term
That's why it's written in big letters on the front of the V5

Not possible is it? Lease company owns a car, you are responsible to tax and insure it. V5C will be in your name as the keeper. It's about the time the legal owner and registered keepere had to be the same but with another section adding for if the cars a lease/loan car to put in whoever is using the vechile long term
