Hi
Wondering if anybody can help.

I sold my car to wbac recently. They lease an office space in a nearby hotel.
I parked my car right outside their office and where the wbac employee told me to.

I have then received a ticket from Parking Eye saying I didn't buy a ticket. They state that the time I was parked was 1230 to 1545
However I sold the car and was on my way home by 1400hrs.

I appealed the ticket with Parking Eye giving the reasons above and they have just denied it.

I know the next stop is popla.

Can anybody advice whether I have a decent case and what approach I should take?

It’s not your car, you should’ve told PE to contact WBAC.

Pay it within 14 days for a discount and move on. WBAC aren't going to be interested, and unless you actually did buy a ticket then I guess Parking Eye have a case.

Sorry if I sound blunt but I can't see anything else that would work. Hopefully WBAC didn't kick you in the goolies too hard.

How did WBAC pay you and at what time?

Google maps would show your journey perhaps?

What's the time on the ticket? Surely if the ticket time is after you sold the car, it's not your problem. if its before you sold the car, then it might be your problem.

This is the problem. It's a bit of both.
The PCN says car parked between 1230 and 1545. I sold the car at about 1400hrs. My invoice should prove this. I will also have an uber receipt for about this time for my journey home.
So an hour and a half was whilst the car belonged to me, and an hour and forty five minutes when it didn't

A charge for you and WBAC?

Car parked without a ticket and in breach of PE's terms... two owners whilst the car was parked up.

Looks like PE have missed an opportunity... smile

In that case I'd tell them to fk off and take you to court if needs be.

You cant say to a court "the defendant was driving somewhere between 50mph and 90mph but we don't know exactly when and we don't know exactly which of the defendants was driving at the time".

They might have sent an invoice to WBAC as well maybe.

Not confused at all, except for the "popla" bit. I owned the car when I parked it there. I'm not going to miss 25 quid so much that I'd worry about it.

If WBAC leases the space for its customers, then surely they can get the fine cancelled?

Assuming that's not the case -

If the car park operator required you to buy a ticket on entry and you didn't, then I would think that you were already liable for a fine at the point you sold the car.

That said, there is case law on the enforceability of signage at car parks and it might be worth doing some research first.

Assuming you have to pay the fine, you would then need a legal cause of action to claim it back from WBAC.

If the WBAC employee convinced you that there is some kind of lease that allows you to park there but they were wrong, then they may be guilty of misrepresentation (if that's untrue) or negligence (if their lease had expired or they directed you to the wrong space).

Not really sure why this scenario is even a question. OP parked there whilst owning the car and didn't pay to park. Aside from any technical wriggle-outs, OP is clearly liable.

Would OP ask WBAC to pay for a speeding ticket he got an hour earlier?

Firstly, the ticket is correctly issued so it needs paying. As PE currently have you on the hook for this, I’d advise paying it early to get the discount and have that issue squared away.

Then I can see 3 possibilities:

1) you write it off

2) WBAC actually have an arrangement with the car park and will agree to pay you back if you approach them

3) WBAC don’t have any arrangement, the WBAC employee will deny telling you to park there or will say he assumed you would buy a ticket. Either way they won’t cover the cost of the ticket.

If you want you could make a quick phone call to WBAC to see if option 2 has any legs, but personally I wouldn’t expect anything to come of it.

I think PE use IAS not POPLA so not worth appealing. So pay or fight. I would suggest you have a stong case so long as you have not admitee you where the driver.

Incorrect - Parking Eye are a BPA member therefore POPLA is the appeals process they use.

These days, this is unfortunately the way it can go.

It doesn't really matter who owns the car, if I understand right? It's the driver. So OP would be liable at least up until the next person moved it.
Providing that ParkingEye have evidence of the driver, but I wouldn't put it past them to have decent CCTV.

Chalk it up to a lesson in observing parking regulations, imo.
