I posted an earlier post on Homes, Garden and DIY forum, the same covering a request I had received from a leaseholder to complete a LPE 1 form (link below).

My further enquiries with the leaseholder, indicates that the leaseholder is neither remortgaging or selling, but attempting to transfer his Lease into his sole directorship Limited company.

The concerns I have, is the possible removal of personal liability for the present leaseholder, both for service charges and other future possible breaches of the Lease.

My questions are, should the other leaseholders/directors of the self management company also be concerned, if so can they prevent the transfer of the Lease into a Limited company.

Most long leases don’t contain any restriction as to whom they can be transferred to. Check the alienation provisions in the lease; the landlord has no right to object to the transfer if there is nothing in there.

Unless the lease says to the contrary you have no powers ( or interest frankly ) in stopping this.

If they don’t pay the service charge then they surrender the lease. Simples
