Caught speeding, license sent off but no points added

One of my friends was caught speeding, he admitted fault and sent his license off after having paid the £100 fine.
3 points should have been added to his license but he's received the license back after a month and no points were added when he checked the DVLA view license details page.

Has anyone ever heard of this happening before? I certainly haven't.

Would you say he doesn't have to declare these points as they are not linked on the DVLA database? I'm rather confused.

Either an error by DVLA or a scam? How certain is your friend that the NIP was genuine from a correct source?
What speed and limit was he caught at and would he be in the area of a SAC as an alternative?

That's the thing, he was pulled at the roadside doing 43 in a 30. It was definitely a genuine letter and he received his license back attached to the letter but has no points 4 weeks on...

If it was me I'd declare it rather than face the possible devastating prospect of discovering you are uninsured after a big crash.

But then I'm a risk-averse type of person

I understand that too, however if they have failed to add the points to the database or whatever has happened then why should he have to declare something that has no footprint in the DVLA system?

If it's a genuine cockup then the onus is on them to sort that. He followed the correct process in a timely manner...

He doesn't 'have to' declare it, but to not do so would be to deliberately mislead his insurers. Maybe give them a bell and ask their advice

Exactly the same thing happened to me a few weeks ago except I was 47 in a 30. I’ve not checked online to see if the points have been added or not but I will do now. Mine was a stop by Lincs police but my letter from from some central unit at Loughborough.

More worrying for me is that another innocent driver may have been allocated 3 points that they haven't earned and come a cropper with their insurance company.

Isnt The question asked by insurers is “ have you been convicted of any driving offences “

In which case the answer is “yes, but no points have been added to my licence” - that way you’ve told the truth and the insurance can’t add anything to your profile because there isn’t anything to add.

I don't think the DVLA database has a field for innocent/guilty. How could they misallocate some points? We've seen before two people in court with the same name but different dob's having their sentences mixed up. If there's human intervention at the DVLA then points could be assigned against the wrong record. You hope that there's all sorts of checks and balances so that can't happen, but then how can people lose entitlements during a simple licence upgrade?

Agree with this. Doesn't seem feasible someone else was allocated the points as it would all be done via license number, etc. (presumably). I guess if they're not showing on the check license detail page online he hasn't actually had the points assigned, which to me is a rare scenario but hey ho, we're only human I guess.
