Hi,

On my drive home last night at about 11pm I stupidly went through the first overhead variable speed limit sign at 77-76mph (sat nav speed) when it was showing 50mph. Not denying I did it, because I did, but the road was completely dead so just tuned out and didn’t think anything of it. I think I was flashed by a camera, there was nothing behind me for a while and only a lorry in front, I think I saw 2x very bright flashes, the other side of the motorway had a few lorries etc.

Do the yellow motorway cameras on the side of the motorway flash? (this is between j16-17 north m6 if it makes a difference).

Do you reckon I will get a ban for this? No previous points or warnings.

How long do they have to notify me of the offence? Is it the normal 2 weeks from today?

Is there usually an option to plead guilty and not have to go to court?

Just over the limit for it to be dealt with at court and not a FPN.

Sentencing guidelines are six points or a ban between seven and 56 days. And a fine of 125% to 175% of your weekly income.

If you are caught at under 76MPH you’ll get a £100 fine and three points.

You might be wrong on that but i cant say i'm got a lot of experience to be sure on it. I got done at 68 in 50 on the m1 last week (genuine mistake, not that it matters) and thats a 4-6pt/7-28day ban & 100% 1week wage.

the infraction came through within 3 days (tuesday offence, got letter on friday). sat twiddling my thumbs for the NIP now...

+21 over the limit does appear to be in band 3 of the limits so that'll likely end up with a court summons in the internet info is right (https://www.rac.co.uk/drive/advice/legal/speeding-fines/)

75/50 mph and below is £100 Fixed Penalty with 3 points. Motorway course may be available if not too far over the limit.

76/50 mph and above is court proceedings but not necessarily a traditional court hearing. In 2021, proceedings are commenced using the Single Justice Procedure. Plead guilty online or by post if you don’t have an internet. You can’t actually attend the first review of the case by a Single Magistrate.

The poster quoted, unfortunately, read something on the internet and simply repeated it without any real understanding and has assumed convicted after trial!

I assume a guilty plea at the first opportunity. If guilty plea at SJ stage then ignore nonsense about 125-175% of income. The most likely fine would be 100% of net weekly income with a range of 5/6ths to 7/6ths - subject to a maximum fine of £2,500. Also, prosecution costs and victim surcharge to pay.

There isn’t a maximum ban but the MCSG refers to 7-56 days. Otherwise, 6 points. Points more likely than a ban in the circumstances described.

well got my NIP through earlier - 68 in 50 on M1 has got me 3points+£100, not the 4pts+ & 1wk wages i was expecting. no awareness course offered despite a clean licence so guess i was still over that threshold.

68/50 was always going to be a £100 Fixed Penalty. You could have achieved better value for money driving at 75 mph. Same outcome.

Google isn't your friend for speeding fines.

Is it possible to get 4 points? I thought it was either 3 or 6, in my case I’m assuming 6

I mean how accurate are Sat Navs / Dashcams?

Dashcam said 76 and Sat nav said 77.

To be fair, I don’t know the details of exactly what the OP did, but it still baffles me that someone can be traveling at 75/76mph in a 70 zone and suddenly passes a variable 50 when the road is empty and clear and as a result risks losing their license in a ban for not slowing down quickly enough.

It’s hardly the crime of the century on an empty motorway.

Not to justify what I did, but yeah this is my feelings towards it as well. I’m being potentially prosecuted the same as if I did 110mph on the motorway, but in terms of “danger” all I did was stick around the national speed limit a bit too long (I know I was 5mph over national). Yet my entire journey that night I passed multiple drivers sitting in the middle lane clueless and not overtaking anything, and 2 lorries on mobile phones. Obviously that doesn’t justify me speeding but it’s annoying how many people get away with mobiles and lane hogging on motorways.

I wonder if all of these 'Clueless Other People' you mentioned, managed to see the GIANT 50 MPH signs above on the overhead gantries and slowed down in time?
I speed all of the time, but I do try to stay half awake!

Just to give you alittle hope...

While back I was going M1 South, accident so variable limits pop up. Clear the accident so accelerate back up to national limit completely oblivious to the gantry about 80 meters past the accident still showing 50mph. I pass it at about 65mph and flash, flash. Bugger.

Never heard anything about it though definitely more luck than judgement.

Maybe they did, maybe they didn’t. Shame though they can’t see lane 1 & 2 are clear and decide to stay in 3 & 4 biggrin

All I need is hope for the next 14 days lol. Maybe they had been set but not for long so might get a grace period to adjust or something I’m not sure, only time will tell.

mmm and on the section of mway the OP got caught, a section i use daily, the lowest speed is always at the camera odd that confused

I find myself now if on new roads or motorways rarely going above 56 mph.

Recently on the A13 I had a 50 mph average speed section (from 70) and then within that a 40 mph section. So with 56 on the clock it was easier to adapt to it all.

Maybe that is the intention - we get feared in submission.

For most it would seem that for the reduced limit the camera is triggered for it around 30 secs later, giving plenty of notice to slow down

I got done a few years back on an emptiy motorway on a Sunday evening. 82mph in a 70, no limits showing on gantry, it was on the M5 by Bristol, they are on 100% of the time.

The photo shows the amount of time the camera has been set at that speed so not sure if they give any grace if they have just changed
