Genuine story

My mum was in a park enjoying the sunshine. She called me to collect her. No space in car park so I parked on yellow line which has restrictions between 11am and 12 noon. I parked about 11.01. PCN issued at 11.05 after observing from 11.03.

Mum has a blue badge which I put in my dash when collecting/dropping her off. I don't keep the badge with me. It stays with her as it should.

I come back to car to see a warden just about to ride away. PCN on windscreen. Mum with me using her walker. Blue badge in hand. Dude rides away.

What's the point of a blue badge if you cannot use in these circumstances?

It would be wrong for me to keep the badge with me. The advice is to collect it from the owner when going to collect them which is what I tried to do

If I appeal, does the "reduced rate" stay until I conclude my appeal? I suspect they will reject the appeal and I will appeal again to the higher authority. Will reduced rate apply until the outcome of second appeal?

Reduced rate should be deferred until after appeal, assuming the rules are consistent across the country. My wife had one recently which we lost but we paid the reduced rate. When you appeal they should confirm it.

I keep my relative’s blue badge with me. No point in them holding it for exactly the reason you have experienced.
(I don’t use it unless I am dropping off or picking up the relative)

How many other people transport her and need to use the badge?

Providing you act promptly the reduced rate should remain. Although be it a genuine story one could easily use this scenario without having actual evidence?

Three other people ferry my mum around. Two brothers and sister and me. Four in total

She needs to keep her badge with her for this reason. Someone else dropped her to the park. She was there for a while with her friend then needed to be collected.

Difficult one then.
Not easy but I presume the only way round this in future is for you to park further away where there are no restrictions, walk to collect the badge then move the car closer for the pick up.

Forget all the issues about who keeps the badge. Surely you can’t park on yellow lines with or without a blue-badge (unless signs say otherwise)?

I agree with this, except that it's not difficult, follow the parking rules like everyone else has to.

I agree with this, except that it's not difficult, follow the parking rules like everyone else has to.
Agreed, as parking where he did was (arguably) for the OP's benefit/convenience, not his mother's.

I wold still write to them though, mother in need of help, 3 minutes etc...

I shan't go into the ins and outs of her medical history and why she has a blue badge etc

Challenge this, as ''The offence did not occur'

There are exceptions to parking on DYL and YL

Yours will come under for boarding and alighting people who need assistance. you are allowed a REASONABLE time in order to do this eg you have to drop/pick up a child of at school and present/collect them to another adult inside. The child cannot be expected to go unattended

Another is to assist a disabled person to/from the vehicle. in order to do this the vehicle has to be unattended again a REASONABLE time should be allowed

This does not mean to have a cup of tea and chat for 10 mins, but to keep it to a minimum. If your parent required assistance from where she was to the car and it was done without delay then you are on pretty solid grounds

If you need to put this up on pepipoo.com of the parking section om MSE they will give you the same answer.I know as this was explained to me when i was driving a minibus that carried disabled people. esp if they lived upstairs and needed to be put in a wheelchair, to/from the bus, or a blind person be occompianed, we never had a ticket in the 10yrs i worked there

If the council turn down your appeal the next step is to go to a tribunal, again those sites will assist you in putting forward a good case BUT remember this Tell the truth DO NOT add or miss out bits, be precise on timings if they find out that you are be economical with the truth, they will drop you like a hot brick, but from what you have originally said, the Council should cave in on appeal .BUT they are rapacious bds and want the last drop of blood.

As far as the ticket rider was concerned, at the time of ticket issue, the badge was not displayed and therefore bang to rights.

Morally if he had seen you with the badge, then he probably should have cancelled it, but the rules may not allow him to have the power to do that.

You are going to be relying on goodwill at the councils ticket office to get off this one.

I would write to the council explaining that a few people can collect or deliver family and that you do not keep the badge so it can be awkward to get it at times and could you have extra disable badges to allow this or write a letter with a photocopy of the badge stating you are collecting the badge and person and you can leave this on the dash of the car .
It may help but may not worth a try though.

While I can see this isn't the easiest or simplest process but...surely OP should have parked legally, gone to meet the badgeholder and collect it then move the car to a temporary location display the badge then assist her to the car.

If you have to get out of the car and leave the kerbside to collect the passenger you are not stopping "briefly", you are parking.

I can see both sides but I'd lean toward the council side.

Tbh, I don't have much hope. But nothing to lose in appealing

Incidentally, if you park in a council pay and display bay, you have ten minutes grace from expiry time to when the warden will issue a PCN. Does this apply to yellow lines (wishful thinking)???

I think the parking warden would know if the grace period applied (or not) to yellow lines.
