My sons Girlfriend has just purchased a new to her car, she was not given the V5 from the dealer and has been told that the original owner has possession of the V5.
I asked how she taxed the car and she said the dealer said the car is still taxed buy the original owner as she still has the V5.
this has me confused .
She has insured the car as her own but it appears the original owner has not filled in the documentation and remains the owner of the car hence it still being taxed.
This sounds a cluster fxxk to me , am i over thinking it and it will be fine or can the original owner say its my car,thank you.

Not always true, there are many above board reasons why there may not be a V5c present at the point of sale, if bought from a proper dealer there should be nothing to worry about, although in this case it sounds iffyrobwilk said:

OP was this a Bona fide dealer or just some bloke trading cars from his back garden?I asked how she taxed the car and she said the dealer said the car is still taxed buy the original owner as she still has the V5.

Sounds like maybe half a story - I’d be seeking to speak to the dealer to clear it up and get the full picture.
Why are they selling the car without docs?
What are they doing to transfer the registered keeper to your daughter?
Are they intending to let her know when her car stops being taxed due to change of ownership?
I’d be going to the dealer directly to discuss.

she thinks it a bona fide dealer, i don't know the facts.I bought a bike from a dodgy as hell seller. Only got the new keeper supplement from him, still in the previous owners name, albeit with tippex over it. Completely useless.
Get a form V62, fill it out and send to DVLA. Theyll contact current registered keeper, to which they will confirm sale or ignore. After no response, and assuming they don't try to claim its still theirs, you'll get a log book in the post after a few weeks. Can't tell you how long it'll take at present, but I have sent a V5 in the post recently, and had a new one within a week or so, so potentially not that bad.

The vehicle was a 2006 Mini convertible on a private number which the previous owner was meant to be retaining, the garage said they would sort that out and must have taxed the car for her using the new keeper slip.
She kept getting calls from the previous owner saying they wanted their number plates back, to which she always replied yes not a problem but you can do all the paperwork and pay for the transfer. She hadn't got the log book from the garage but they always said they had it if she called in when passing which wasn't really likely since they were an hour away, but the y did send her a pic of the V5.
Fast forward a few months and I got a call from my sister, her hubby had got involved and that morning had phoned DVLA about a replacement log book, then filled. in the requisite form to send off. My sister was concerned he hadn't done things right so called me, I asked her to send me a copy of the V5 pic and some other details and I would check it out.
It turned out that the garage had done the reg change six months before and her car was registered to its original number, likewise the previous owners car was registered to the private number not the 66 plate she was driving around on, the really strange part of this was that the V5 the garage sent the picture of was a current one in my niece's name and address with the correct reg for the vehicle, how the name did they manage to get that as it should have come direct from DVLA to my niece

3. A decent HPI report will answer most of the issues you mention
4. Just use a V62 and wait for V5 to turn up, it's still got VED on it and likely will have until the new V5 arrives

The Reg document that the keeper has is a V5C, a V5 is for a new vehicle for the dealer to do the first registration and tax, although that might be done online now, been out of the game for a while, things have probably moved ontwing said:

Nowadays everything should be being done instantaneously online anyway.
Without the V5 what do you have to say the car is legally yours?
Theoretically, if its still in the previous owners name whats to stop them getting the car back? Its the same if you buy a joint car with a partner then split up afterwards, if the V5 is in your ex partners name, say goodbye to the car.
