Hello
I collected a car Saturday 4th December, which had a new MOT the previous day 3rd.
When I viewed the car two weeks prior, there was an inoperative brake lamp and a defective tyre.
I had to purchase glass cleaning equipment due to the inability to see through the dirtts windscreen, on doing so I noticed the tyre had not be replaced, the stop lamp was not corrected.
So looking further into this, it should never have passed an MOT, other faults I have found, a split inner driveshaft gaitor, excessive wear to a front wishbone bush.
It appears this car has had a fraudulent MOT.
I've notified the garage, whose response is, you have warranty on this or if still not happy return the car car for a refund, as long as the car is in the same condition it went out.
The problem I have with a refund is I wil lose out, the money I've already paid out including the extended warranty I paid for.
Any thoughts on this, much appreciated.

What would you lose on the refund? Surely they would have to refund the full amount you paid including the warranty?.

OK you will lose out on the cost of the glass cleaning materials etc but that seems to be a small price to pay to avoid getting lumbered with a dodgy car.

Also worth reporting them to Trading Standard if they are knocking out fraudulent MOTs.

Whatever the outcome the last thing they would want is for you to report them: https://www.gov.uk/guidance/report-an-mot-tester

That's the first thing id be threatening/doing.

I seen a thread on here this week, similar situation but the salesman apologised, offered to fix it and said the last thing they wanted was to jeopardise their mot license.

Why did you have to clean the windscreen to notice the bald tyre and inoperative brake light ?

You are entitled to a full refund, I would bite their hand off.

Why not say to them that you could get them in some serious trouble regarding the dodgy MOT they just done, but if they fix the things it should have failed on you will call it quits.

What else did the MOT miss?

The only way I would keep it is to take it to a reputable MOT tester with the approval of the dealer, and depending what they find either ask the dealer to pay to fix or get the refund offered.

If the dealer says no to this you can maybe draw your own conclusions.

Thank for the reply guys.
I bought the car from a dealer in Peterborough.
The windscreen was filthy, so I had to get it cleaned, that when I noticed they hadn't changed the tyre.
The brake light was inoperative when I viewed the car, so I reasoned it would be repaired for the MOT.
They have now stated they will only pay for one tyre.
I've taken the car to a registered MOT tester where the other faults were found.
Also there's a noise when releasing the clutch, which they told me about, I didn't hear it on the test drive, but it's certainly there now, they are saying to take the car to a vat registered garage and use the warranty to get it repaired.I took the car to get estimates for the MOT repairs, passed it on to the garage, their response, I was happy with the car on the test drive, get the car repaired under warranty, or if I'm still not happy return the car sa it left them for a refund.
Do you know if it's possible, if I pay out for the repairs, could I claim the cost from the garage ?

I would wager that you will get no refund from the dealer for any repairs you pay for, they will use the warranty as a get out or say you should have taken the car back to them for any remedial work.

Either get the dealer to agree to pay for any third party repairs and get the invoice sent direct to them for payment, claim off the warranty and see if that will pay out, or get the refund.

Ah Peterborough ….. plenty of iffy mot and garages around there, I live up the road in Stamford and I’d never buy a car from Peterborough.

While you can get the test station in trouble it won’t make much difference to the seller

While you can get the test station in trouble it won’t make much difference to the seller

The dvsa inspector spends a lot of time in Peterborough, you can contest the mot but given you have reapaired it I’m not sure what you will gain.
The seller might be running their own MOT test station too.

A couple of years ago I had the same thing happen to me - bought a car, but after getting it home and looking over it, immediately realised the MOT was fraudulent. The dealer I bought it from had an MOT station next door (different name - but I later found out both were owned by the dealer).

It probably happens more often than we realise.

You had to purchase ‘glass cleaning equipment’?
I was given to understand cars have washers and wipers - and even so if you wanted to do it by hand you could have used a £1 bottle of Windowlene and some kitchen roll.

Take the car back to them for repair or a refund - the garage won’t pay someone else to fix it when they could do it.

Agree the best thing for you is to politely but firmly request a full refund. If you let others touch the car they will say the others have caused issues.

If this garage is as bent as you indicate, agreeing to a refund less £25 or so could do it (only if they keep dragging it out). Wrong if you have to do this but probably cost effective and it ends it all.

Go for the full refund first and push hard.
