Advice needed regarding a small accident
Discussion
Good Evening,
In October I was involved in a motorway accident. My car aquaplanned and hit a barrier. No other parties were involved and I wasn't injured.
The barrier wasn't damaged, and a Highways England guy swept up and moved my car so that it was on the hard shoulder. Highways England have contacted my insurance company trying to claim £6k to the barrier. As I said the barrier wasn't damaged. The police attended the accident and the officer recorded that I hit the barrier but noted that his recommendation to Highways England was no further action.
Is there a way that I can obtain the report from the police?

I doubt that Highways will be making fake claims. There maybe damage that can’t be seen. In October I was involved in a motorway accident. My car aquaplanned and hit a barrier. No other parties were involved and I wasn't injured.

The recommendation from the police will be that no further action is taken in relation to any driving offences. Not that they can’t claim against you.
Your insurance company will be aware of how they need to get a copy of the report. However, it’s unlikely to show that it doesn’t have structural damage etc.
If you hit the barrier you will have more than likely damaged the z posts holding them up. They would need replacing so the barrier can be rehung properly.
Did you check the z posts ? The police aren't usually that bothered. Seen elsewhere the BIB said no damage but the driver had wrecked 6 sections or central armco.

To what end? If you want anything, it’s a copy of the invoice broken down to line item detailing how HE have come up with their number, which really has been got to by whichever 3rd party firm did the inspection/ any remedial work. There’s no way you will have been able to assess what, if anything, needed to be done from the hard shoulder after you clattered into it at motorway(ish) speeds. Anyway, it’s your insurers problem not yours Is there a way that I can obtain the report from the police?

How badly was your car damaged? That might be a good indication of how hard you hit the barrier and how much damage you may have caused. In October I was involved in a motorway accident. My car aquaplanned and hit a barrier. No other parties were involved and I wasn't injured.

AIUI barriers are meant to deform to absorb the impact so if HE were "sweeping bits of your car up" the barrier probably took a fair whack.

AIUI claim value has little effect on insurance costs so move on imo.
