Fine for untaxed car parked on public road

I have had a letter come through from the DVLA issuing a £154 fine for a car being parked on a public road untaxed.
The background is, I bought the car at auction and transferred it into my company name, so it was in effect registered as belonging to a motor trader, which as I understand means they don't automatically issue a fine. However, I parked it on a back street behind my house as there is nowhere on my property to keep it. I assumed this wasn't a public road, as it is just a narrow cobbled back alley.
The police did actually ring us about it (my number was on a 'for sale' sign in the window) to make sure it wasn't abandoned, and to ask about there being no tax disc, and we explained the situation to them, and specifically asked them if it was OK parked where it was. They said it was fine, and we heard no more about it until we received this letter. We have contacted the local council and it seems this back alley is in fact a public street, so it wasn't OK there despite what the police said. :rolleyes:

D-Angle, Whilst I concur with Vipers reply I sympathise with you entirely.
Years ago, whilst in a "terraced property" I parked a "second" (off the road car that was was being restored)car to the rear (entry) of the property. It was stolen one night, after which I parked it in the side street (small village).
One Sunday morning a "constable" was passing with a "newby recriut", looking for "CRIMS"! for him to "Nab".
Having moved it from the rear to the side street in fear of it being stolen, .....I was duly......summmonsed to appear before the court as being a crim! Tax...an all! Even though I had a second much younger car fully covered!
I'm Lucky mate! If I had an untaxed car now, it wouldn't be a problem. Why?...........because I have room to place it on "private land". I didn't then!
For those that DON'T! I think the LAW is unfair!
I have NO truck at all with those that leave their cars outside homes without moving them.
If they move!....daily, then yes. But!.....If they are plainly NOT being used?.........WTF?

SORN applies where a vehicle is kept off road untaxed.
It provides continuity in relation to history of the vehicle in relation to excise.
Car left of a road repairable at public expense has to be taxed (and insured/MOT?). SORN does not cover this.
If they take you to Court the longer it is untaxed the more back duty to be paid.

I registered it as being in the possession of a motor trader, which is similar to SORN, in that it provides continuity in the tax history of the vehicle without it having to be taxed. I checked this with DVLA who said it was fine, it would need tax only when it was in the hands of another private owner.

Surely if it had no tax disc then it should be on "trade plates" or parked off the road?
