my wife and i had a hotel room booked (through Booking.com) in manchester in December, but i got COVID a few days earlier and we couldn't travel. It said on Booking.com terms that it couldn't be cancelled for a refund at this point, but it made no mention of restrictions on amendments. So, I set about trying to move the booking, which Booking.com site let me undertake, and lots of dates were available to choose showing availability. However, each and every time the hotel manually rejected it, citing some amendments policy. So basically, the hotel and the booking site were working to different terms, and the hotel appeared to be working to more restrictive terms than Booking.com. My contract is with Booking.com, but when I raised it with them, they gave me some flim flam about the hotel needing to approve any amendment. I looked on the hotel's website and they don't even publish an amendments policy there. The booking confirmation didn't state an amendments policy or rules.
So, I raised a section 75 with the credit card company. They took months to process it, but i recently received a rejection saying that they could not prove breach of contract.
It isn't really about the money now... i just feel that an opaqueness was introduced which felt very unfair, and the hotel just decided they wanted to exert all efforts to just keep the money despite this being somewhat reasonable.
Any tips?
