NCP Parking Ticket Fine

I was in an NCP a number of months ago came back and the machine wasn’t working to pay. (Should have taken a picture!) They have also just implemented a new registration recognition system. So I tried to download the new app really struggled with it and it wouldn’t take my payment, but I felt showed an intent to pay.

Rushed off to next meeting, get fine in post so I emailed and noted that clearly the machine wasn’t working in the time I was there and happy to pay for parking time, I’m sure their records show no payments at that time.

Anyway gone to ombudsman that sided with ncp, then debt collectors (added £70) now solicitors (added further £60).

Seems a right racket this. Not moaning but I don’t want to pay. Anyone else not paid in this situation.

Which only happens if they take you to court.

I'd be inclined to turn up at court with the evidence that you tried to pay, that you offered to pay for the parking and with a counter claim.for harassment causing stress.

I am not a lawyer but even if they do take you to court and you lose - you'll only get a CCJ if you don't settle up after the court case.

Pepipoo forum is the best place to understand the current approach.

Probably. I asked as the ncp I use has barriers at the exit and you either use your paid ticket or Q code to lift them. I assumed that set up would be at all their car parks.

CCJ against you the least likely outcome. They’d not only have to send you a Letter Before Claim and start a court claim, and then win in court (with the unlawful “debt collection admin fee” taken off by the judge). But you’d then need to fail to pay the reduced final amount to get a CCJ recorded.

The problem there is he doesn’t have any evidence he tried to pay! States the machine was broken but no pic and states couldn’t work an app.

If offering to pay after the event were widely accepted then nobody would pay for parking contemporaneously as they’d just bank on not getting a fine in the post.

OP was there only one machine in the whole car park?
