Warranty claims

Hi all, I just wondered if someone could give me guidance as to the legalities on the following:

In January 2021 I purchased a TV from Argos for my son in cash with his Christmas money (£300). I seem to recall it had a 2 year manufacturers warranty.

Fast forward 15 months and it's broken (no picture, only sound). I've spoken to the support at Hisense, and they want the receipt. Here lies the problem, I cannot find it.

They're saying there's nothing that can be done without it. The TV has a 'Production date' on the reverse of November 2020, so there's no dispute that I'm within the 2 years.

So are they correct, and they can insist on the receipt? Without it they won't honour a warranty claim? I've even been to Argos and they say there's nothing that they can do to reproduce a cash receipt from January 2021.

Most warranties are not transferrable by default. They'll be wanting to know it was you who bought the telly, and not someone who got it off you last year via Gumtree. Which is understandable.

If it was within 12 months Argos would want some form of proof or purchase, even if just a bank statement. You could have bought it anywhere as far as they are concerned.

Any warranty will need proof of purchase so they are correct.

100% agree if I was trying to go to Argos. But my point is, the warranty is with the TV manufacturer, where I bought it from is of no importance to them (is it?).

I know to the average person it sounds dodgy, but I genuinely can't find the receipt, I've searched high and low, and genuinely paid cash with his Christmas money.

I thought someone would have been through the courts in the past and case law be precedent set? I understand the receipt will verify it's within the 2 years, but they put a production date on the back of the TV so that's not in doubt.

In my former retail job, we could search receipts in a number of ways. Card was easiest with a date range but if you gave in any personal details such as postcode then it became pretty simple to find it. If you can approximate a date and price, cash payment method, price and use the same branch you bought it from, it shouldn't be hard to find. Quite how effective Argos staff or systems are, I can't tell you. Best piece of advice is to be polite. If you go in barking orders, staff will shut down and refuse to help you. Remember, it's not their fault the receipt has gone missing.

Any chance Argos emailed you the receipt? On Gmail the ALL folder keeps things for years

When I worked at PCWorld many moons ago, we had to put in details for TVs. Something to do with licensing iirc. But, we could search based on surname and postcode to get the info and reprint.

According to this article Argos stores in January 2021 were click and collect only. The TV must have been reserved in advance.

No, but WHO bought it is. You can't show it was you. They offered the warranty to the purchaser. You can't show that that was you. You could be anyone else as far as they are concerned. Their contract is with the purchaser.

I get the odd person who has one of my kits (bought it 2nd hand off someone else) and wants warranty replacement parts, and when I tell them I can't find their order (via their email address) and ask can they show me the order number, or give me the right email address, the conversation stops dead in it's tracks :-)

That relies on you agreeing to give it - I don't, nor at Screwfix, or Toolstation or Fat Face, or Crewe or.... any of them :-) (because every single one of them, without exception, abuse it and start spamming offers to you, regardless of you telling them they can't)

Didn't Argos take Name Address etc, at the time of a TV purchase.

I think it was done in the past for TV licensing

Been to the courts and set a precedent for what? They’re doing nothing wrong.
If they need proof of purchase then it’s as simple as that. For all they know it’s second hand, off the back of a lorry, nicked etc
