Stolen BMW Recovered...Not by Police

Hello,
My mates BMW financed lease car got nicked about 6 weeks ago, obviously he had full comp insurance and gap insurance and claimed on both so claims settled in full.
Last weekend he spotted his BMW outside a body shop in bham so I drove him back to his house and he still had the spare car key keyless thing or whatever he got from his house and we went back to the place where the beemer is and he got into his beemer and drove it back recovered it back to his place.
Questions are:
- Is he still legally allowed to drive the beemer because its not stolen anymore and its recovered?, or does he has to notify the police station 1st to make it legal before driving it and does the police automatically from their records notify the insurers, lease company and finance company ? Or regardless can he be arrested for car theft unless he proves to the police its his car?
- Okay finance, lease companies got their pay-out settlement from the insurance claim so that means the car is not still legally owned by them right?
- After all this who is the legal owner of the BMW?
- What's the correct legal procedure in steps to sort all this? Once the police take off the stolen red flag marker off their databases then my mate can legally drive, insure and tax the car and he will leave it up to the lease/finance/insurance company to chase it up?

The car was never his property
The owner of the vehicle was the leasing company
They have been paid out for their loss and the vehicle is now wholly the property of the insurance company
Your mate has no right to the vehicle in any way at all
The Police need informing ASAP and it will be recovered to the pound for collection by the owner
Best we skip over him taking and driving it for the mo or why he still had a key for it !

te if the bodyshop have bought the recovered car off the likes of copart legitimately. If so essentially he has stolen someone elses car. Better ring the insurance and lease co asap. bery_451 said:
