First time post, ive read a lot on here and just wondered if anyone could give any advice.

I got caught speeding last November doing 66 in a 40, its usually 60mph A road but it was late at night bad weather, id had a long day and there was roadworks but know one about. I accept its my fault no problem.

Had I been doing 65mph it would have been 3 points, if no road works it would have been 0 points.

66 + is 5 or 6 points in a 40.

40-65 is 3 points

I will probably get 5-6 points for this.

At then end of March I got court by a camera doing 24 in a 20, two days before I went over a red light and got caught also (only ever done once before in my life) another 6 points.

24 in a 20 with the 10% rule seems harsh but it is what it is, it wasnt near a school or a built up area. All of London seems to be like this now, Is a bit of a nightmare when trying to get about.

I think ive done a speed awareness course in the last 3 years, I probably do 20000 miles of driving a year, its looking like I will go from 0 points to 11 -12 quite quickly,

If I do get 12 points, should I get a Lawyer as I will be going to court does anyone have experience of this?

I understand all my mistakes although could be seen as a little unlucky maybe? Sorry if a bit of rambling, if anyone can help in anyway would really appreciate it.

The reason for being able to get several tickets for relatively minor incidents without getting banned is so you have the opportunity to reflect on how you are going to keep within the law and avoid further tickets.

It sounds like you have ignored the impact of the previous speed awareness course and convictions. The reason for having totting up bans is so that those who keep getting tickets are given a kick in the pants and forced to reflect on how they ended up with so many convictions.

Don't get me wrong, I don't think the actions you have stated here are in any way equivalent to "proper" crimes like theft, assault or murder, but driving is a privilege that can be taken away if you keep on ignoring the rules.

(That doesn't answer your question but it seems to be a concept you've not realised)

I would not say it’s not your fault and make excuses at court.

Your going to get a 6 month totting up ban and if you can really afford a solicitor you can get one but unless they are a wizard I would prepare to lose your licence for 6 months.

Based on your details and 20k a year driving through red lights and speeding everywhere you need to calm down refocus on your driving as there seem to be a massive amount of observational problem unless you speed on purpose?

I have been were u r, I didn’t jump reds however when I was younger, how long have you had your licence?

You say that you understand all your mistakes....
It's not much use just understanding, you need to change your driving standards. It seems that you just continue, unchanged.
You'd probably be wasting your money with a solicitor, just accept whatever is determined.

Speak to AGTLaw on here, he may be able to offer advice on the best way to approach it all.

If you get a driver awareness course for any of them, bite their arm off. Where did you do the last one?

you need a lawyer and you both need to figure out how to argue you need to drive for work. That will save your licence by the skin of your teeth.

If you are successful with this you will be on thin ice. I would get the worst car imaginable where it is impossible to speed for a couple of years. You will need to prepare for horrendous insurance premiums, and substantial fines too.

He has had one in the last 3 years so unlikely, seems it would be a waste on time based on the pattern.

I do know not all forces are very good and checking the database to see what’s gone on, so there is a slim chance.

What’s the point if his behaviour doesn’t change, if he lives alone they are stuffed

You can do a speed awareness course and also a driving awareness course for red lights within a 3 year period.

It depends how long it was on red for when you went through, but if you just caught it they will offer you an awareness course for the red light.

Am I missing something here? Wouldn't an offence last November have been dealt with by now, so you would know what you got from that one. The March ones also, if either an offer of a course or the 3 points for both of those offences, you would have heard back about those as well.

I read it as

  • OP already has 6 points for the March incidents.
  • OP is going to court for the November incident, as it's over the threshold for a simple fine and points. Surprised it's taking that long but Covid, etc may add up. Getting 6 more points in court will see him with a ban

OP - lawyer up. You should have been driving like your Granny after 6 points.

If you need your licence for work, a lawyer may be able to plead your case.

Bit silly getting court in the first place. hehe

That's not unlucky so stop feeling sorry for yourself.

No one seems to get banned these days so just go in with some sob story like everyone else does.

is it still true that if you get more than a 30 day ban, all your points are removed?

If so, I'd go for that option.

I'll remember that one when I'm up in front of a judge or magistrate. Magistrates aren't stupid, but when you're standing in the dock the best course of action at that point is secreting as much remorse as you can, not arguing, and taking the punishment like a good boy.

Alternatively, get some urgent legal advice from a solicitor, attend the court with your representative and allow them to eloquently argue your potential ban down.

A driving DQ for more than 56 day means you have to apply for your licence all over again, so technically yes.

Only a totting ban has the effect of wiping the licence of existing points.

Good luck my experience when I was facing a totting up ban was they wanted to charge a lot for not a lot. I could not find anyone who was very helpful, they seem to focus on why have you been that stupid with points on your licence to keep driving like a bell *nd

I was lucky in some ways as I had a JP in the wife’s family he let slip the only way to get mercy and so I represented myself but I have a background with some legal experience.

Like I said you can avoid it this time but with your record what is the point unless you change, seen it before u dodge it this time, with mileage it’s going to be Groundhog Day.

Get a road angel of Saphe mini in your car that will at least worn of cameras and issues!

I assume you know your speeding most of the time and don’t care?

Only 6 months from member, I got a shirt ban for mine and still had the points for 2 years plus

That's not correct.
