Moped parking fine

Hello,

I've posted in Biker Banter but haven't really received a useful reply.

My partner got a parking fine on her moped for exceeding the 2-hour parking time in a bay on the street in a small market town.

I contested the ticket on the basis of bikes not being subject to parking restrictions (generally), but they have said that the time limit applies to all vehicles.

Does that sound correct? (Signage just states the restrictions, it does not specify vehicle types).

Ah - ok. Thank you. Just seems a bit unfair when she could have legally left it on the pavement opposite.

If the bike could park on the pavement, then a car could also, provided it wasn't committing any other offences.
If the car wasn't allowed to, then the bike wouldn't have been allowed to either (as in London).
If the bike is in car bay, then it should be subject to the same restrictions as a car in that bay.

Sorry, but I thought bikes were subject to different restrictions? The Highway Code specifically deals with the rules of parking of bikes on the pavement (don't cause an obstruction for instance). Bikes can also (AKAIK) park on single yellows.

I can't see anything about parking of bikes on the pavement, or on single yellow lines...

I don't ride a bike so I really don't care, but my (admittedly likely out-of-date) memory is that bikes were not subject to the same parking rules as cars.

It's complicated and even in London there are a few places where you can park a bike but you would expect not to and others are the other way around.
Only guarantee is in dedicated parking.

Bikes can't park on single or double yellow lines.
They can park in motorcycle bays, cars can't.
They can park on footways (outside London) as long as they don't cause an unnecessary obstruction, as can cars.
If they park in car bays they'll have to pay if cars do.
All subject to signage to the contrary.

The main difference is they can park in motorcycle bays & cars can't.

Doesn’t help in this situation but does add to the discussion.

Large council car park in a small town near me I park in regularly. No motorcycle bays so I leave it in a car bay.

2 hours free parking but must display a ticket… now where am I meant to display a ticket on a bike where it won’t get blown away or nicked? Naked bike with no screen or fairing.

Full A bike licence holder here. I'm afraid that double and single yellows apply to bikes as well as cars, although many turn a blind eye to bikes on pavements even in London, we are subject to the same restrictions as cars unless specifically exempt, and same rules to cars apply in car parks unless special provisions have been made for bikes. Unfortunately, your other half won't be able to contest the penalty on the grounds that the charges don't apply to bikes or that she could've parked elsewhere for free. Sorry!

Just to bring a bit of experience and advice for your partner, other things to bear in mind are that bikes are allowed in some bus lanes but not others, and bikes aren't allowed in cycle lanes. The latter in particular may sound like nothing more than common sense but you'd be surprised at how many moped rider's seem to think otherwise! The bus lanes can be more of a problem with a section not allowing bikes flanked by 2 sections which do allow bikes in within the same journey even if not on the same road, but it's easy to be distracted or assume that the permission for bikes continues.

Anyway, hope she finds these useful.

The fitting of a readily available tamper proof sealed display case, seems like an easy win, to get two hours free parking.

And it’s only one bolt, if you wanted to temporarily remove it for a bike show, or such.
