Situation

Aberdeen Skene Terrace Car Park


My wife has been parking at the above JustPark managed car park in Aberdeen for the last 4 months. She pays monthly via direct debit at £125 a month.

We live in Nottingham but she has an apartment in Aberdeen for work. The car is registered to Nottingham but as I am armed forces and currently deployed so there is no reason for her to travel home to Nottingham so we have a mail redirect on. Post is currently taking around 16-18 days to be delivered in batches to Aberdeen.

A couple of days ago she got two tickets from NCP for failing to pay to park in the JustPark managed car park. So she rang NCP (who she has had no dealings with EVER regarding this and received no correspondence to say they are taking over) and explained that she is paying JustPark and she is allowed to park there. NCP stated that it is there car park and as the 14 days have passed the first fine of £100? cant be reduced. The second one can be reduced though….. (I expect about 10 more tickets are in the pipeline)

She has appealed both tickets received so far to NCP and surprise surprise the tickets have been upheld.

The wife in the mean time has contact JustPark who say they still mange the car park currently I have checked 10 minutes ago and it is being operated and offered by them on there parking app and they state she is still entitled to park there.

On visiting the car park, it appears that NCP signs have sprung up in the last few days (THe fines are from before their signs showed up we believe)


I’m at a bit of a loss as to what to do. NCP despite seeing copies of invoices from JustPark and other communications as proof of payment to JustPark say its there site

She often walks to work and the car often doesn’t move at all. I should point out this is just waste land, there is no marked or reserved bays, whilst JustPark continue to say its there’s, NCP continue to argue it’s there’s.

She’s had enough of both of them and has gone elsewhere so its no longer an issue from today onwards but i fear a string of tickets at £100 a day for 10 tickets.

My advise to here was to appeal them all. Then write a covering letter to NCP stating our position that we believe we have paid for the month in question the invoice for payment to justpark expires 08 aug 22 and that we wont be paying. If they feel there in the right then we are happy to see them in court if required.

JustPark continue in email correspondence to claim they are operating the car park still.

Currently it’s available via the JustPark APP to pay to park at but its also available on the NCP app. Although I have noticed its no longer on the JustPark website.

Any guidance because I’m at a loss when they both claim they are operating it. I half wonder if the owner of the land has leased it out to both parking companies.

Ask just park for a copy of their contract with the owner of the land.

The only time I ever got anywhere with a parking company was to contact the solicitor who was dealing with the fine directly. Anyone else was completely lacking in common sense. Good luck.

Is there more than one area? Possibly zoned for each operator. Unlikely but something to check.

Presumably there must be other people affected by this - can she make contact with them and maybe get the local newspaper involved?

Actually thinking about it, more likely they have ‘partnered’ and their systems are not talking to each other.

Nope it’s a tiny bit of waste land than could fit maybe 15-20 cars maximum.

I'd go Twitter on this, and introduce them to each other... Perhaps ask if they need to talk!

or / and I'd email both CEOs and also introduce them to each other and ask them to talk!

That was my response to her..Unfortunately I made the error of saying your probably going to get a load of threatening letters saying the world will end if you don’t pay up..It quite upset her and I probably wasn’t as compassionate as I should have been (it had been a long difficult day at work).

I explained that they can’t do anything until they have won in court and then only if we fail to pay within 28 days..Before then its just all bluff and bluster trying to scare you in to paying up.

Any solicitor with half a brain knows that subject to JustPark still having the right to manage the location and if they have partnered with NCP as per the previous link then they don’t stand a chance as we have an invoice for payment..

It’s not helped by me being 1/2 way round the world on deployment..

What’s pissed me off most is that it’s upset her.

Yes that's hard. If it's your own fight, it's fine. If you are advising more sensitive souls it's much harder.

Appeal to POPLA with the evidence that the car park is managed by JustPark and that she has paid so no contravention has taken place.

As you have a contract with Just Park I would contact them and ask them to clarify in writing if it is them or ncp that are doing it now .
Or give them 10 days to reply and sort it out .

They were JustPark and NCP signs there when she parked. There have been for the 4 months she has been using the site.

Sometime whilst the car was there last time the JustPark signs have disappeared.

Either way she still has an paid invoice for parking up to 08 Aug 22. So has never parked without having paid.

She has received no communication from NCP or JustPark about who runs the site prior to her getting the tickets.

See the email images in my OP. My wife has contacted JustPark who say they are still managing the car park. They have confirmed it in writing already. They have also issued an invoice saying payment up to 08 aug 22 has been received.

I will advise my wife to see if JusrPark are prepared to do anything to sort it. I very much doubt it though. She has decided to park elsewhere as she can’t be doing with the agro caused.

^ This, exactly. Then don't lose any sleep over it. If they want to take your wife to court then they'll write again with a letter before action. In that instance, your wife should give a brief response referring them to her previous correspondance & stating that if they pursue it to a sheriff court action then she will counter-claim for a day's lost earnings due to their spurious & vexatious claim. I'm very confident that NCP won't pursue it - not once someone with half a brain in their legal dept looks at it.
Can we actually sue for costs. I thought small claims you couldn’t claim costs.

My wife earns between £500-600 a day so it would be handy to know if we can claim that back.
