driving along a local dual carriage way in darkness i was in a borrowed (main dealer loan car) mercedes, anyway this is what happened

as i was driving somehow i started to wonder if the main lights were turned on ( as they are xenon and very white and im not used to xenon as they light up whole road rather than beams of light as from normal lights!) anyway i momenterily turned off my lights and immediatly turned them back on so they were off for a split secomd. once knowing they were on i proceeded to drive on after about 30seconds i noticed i was being followed v closely by a old ( 3 / 4 years) ford focus being driven by a aprox 40 y old man and a passenger with a skinhead hair cut who was poss early twenties ! i turned off the dual carriageway and was still followed for next ten mins as i tried in vane to find out if it was just my suspicious mind that i was been followed or weather they actually were! anyway after ten mins i pulled into a garage forecourt and jumped out by this time the driver was out showing warrent card and approaching me saying " cid " it was only at this point did i realise it may be police as they didnt look like typical oficers and thers car was a cid car totally ummarked. they said i had turned off lights and was speeding aprox 100 mph, then a patrol car turned up and cautioned me ! the cid left scene before i was cautioned, when i asked why i was cautioned the officer in patrol car said he didnt kno till he read their statements and had there car callibrated.i was breathalised. then i showed him what i had done to turn off lights explainong the swich was in the auto pisition and the next click is off! i thort i was in full lights and next position is side lights ( hope you understand)if i had turned light from full to side lights my tail lights would have not gone out this is what i thought i was doing. i didnt deliberately turn off my lights for fun.

can 2 cid cops prove i was speeeding with out any evidence other that there word and can i be done for turning my lights off for a split second

comments please cos i thing the cid lads went totally over the top maybe they thort i was an undesireable!

im now waiting what do you think will happen

Unfortunately for you, yes. Some years ago, I was given a ticket by two cops driving the other way in the middle of the night, claimed I was doing 50 in a 30. Not a lot you can do really. In a court your word against two BIB won't count for anything.

Havn't got a clue, wouldn't have thought e.g. a due care and attention charge would stick with that.

When they cautioned you, what offence did they say they were stopping you for?

Also, this is important... If you were accused of doing 100mph, were you doing 100mph or doing 70?

If you were doing 70, it looks like you have been stitched up. I guess that flicking the lights on and off p*ssed them off and gave them the excuse to stop you. Realising that they would have to let you on your way for such a BS reason then the 100mph story which they will both corroborate, is what they hit you with.

Their responsibility to prove both those points, and a stringent denial and a good lawyer would get you off either charge.

The word of the two BiB needs to be to the satisfaction of a the magistrate, and that would be enough (other way, night) to creat reasonable doubt.

The lights could be a mechanical fault, and a HORT/1 surely sufficient to dealt with this...

Also did you really just flick the lights? How long were they off for?

Breathe for heaven's sake! If you write a response to any subsequent summons, put some punctuation in, or they won't read it. Good luck - Streaky

I got done on my bike in a similar fashion.
I was accused of doing 60 in a 30 zone by two officers who couldnt even see me.
I was only 70 yrds from the traffic lights Id just left and it was frankly an impossiblility.
The coppers were absolute s.
I got a court summons and fortunately they didnt turn up so there wasnt enough evidence to prosecute.
Anyway a formal written complaint to the relevant Chief Inspector gave suprising results. It was taken extremely seriously and the CI bent over backwards to accomodate my complaint and be seen to be dealing with it.
I thoroughly reccomend that course of action if ytou hear anything more from this.
