Never good - Was given a fixed penalty notice for speeding in 30mph zone (42 mph).

However, my personal details were input wrong on the form - i.e. he wrote my Date of Birth incorrectly (not sure how he didn't write the correct details from my driving licence on the form!!)

Does anyone know if this can be contested as a technicality?

If you're guilty, why not just pay it?

probably you could claim it was someone else with your name driving your car but a bit older/younger

It's been done before, the question is how good is your lawyer?

There's a website where some guy had this happen. DOB and date of offence mixed up etc etc and he got off. Think it was in New Zealand though.

Makes no difference mate. If he got the date of the ticket wrong you could easily get away with it but as for DoB it makes no difference. Why not contact the Bobby and ask if there's chance of attending a speeding semina instead?? Even if you went to court to plead its your livelyhood, speeding is a minimum of 3 points. There's no way you could get away with the 'someone else in my car' routine. Especially seens as your picture is on your licence. IMHO - and I used to be an officer of the law - You're screwed!! sorry mate...

get a good lawyer, he'll give you the right advice, I would. If the cop screwed up, make the most of it.

Well frankly if it was 42 in a built-up 30 then you were going far too fast and deserve the ticket!

feel free to shoot me down in flames, but are you lot serious. do any of you live in london. if you were to drive at 30mph whenever the local council decided to plonk a 30mph zone you'd be lucky to get home without having some road rage nutter with an axe after you.
i've followed police cars for miles in 30 zones and they're doing 40-45.
i'm all for 30 or less outside schools or villages but join the real world people.

Regardless, this isn't a question of whether or not the speed limit was correct, in your view, for the road but a question of whether or not he broke the law.

Appropriate speed for the conditions & type of vehicle. Hard to comment without knowing where it was.
I know sections of 30 mph roads where actually going at 30mph would be dangerous, regardless. Also plenty of 30mph roads where if conditions were suitable driving at 50 or 60mph would be fine.

What, you mean the real world where there are 30mph zones in villages, towns and cities across the country?

People should stop being complete wits and learn to drive within the law, it really isn't that hard, its a matter of lifting your foot further off the throttle pedal...

ahhh, we should all stick to the law and drive below 30 when it says so, and oh, BTW, that means below 70 on motorways. As we all know, speed kills, we don't want to be killers do we. We'll all be safe and live long if we just stick to the speed limits!

I exceed the speedlimit everyday. The subtle difference is that I know I'm breaking the law and if I get caught I'm not going to try and wriggle my way out of it. I know the risk and I accept the risk and the possible consequences.

Did you not the Trevor Macdonald program the other night about speeding where 4 50+ year olds (one guy in his 70's and never been caught in his life) were prosecuted for speeding in a 30 limit where the road looked like a NSL 60 road all bar one tiny 30 mph sign. You need to know the full extent of the circumstances before flaming this guy. Especially as he has asked about a technicality.

I'd leave the speeds off next time to prevent this kind of unnecessary response.

The "law" is trying to get us everyday with whatever means it can to get the cash out of us, down to the last letter of the law. So if there's a way out because the "law" screws up, then why not? If I screw up, the "law" is not going to let go that easily!

Plank... sorry to be blunt, but use your brain man or are you a sheep!

I know plenty of roads around me where they have slowly dropped the speed limit from NSL (with no accidents) to 40 and now to 30, which is completly inappropriate for the road 99% of the time!

I know the law is there to be obayed and we can't just pick which bits we obay. I do try and stick to these daft speed limits most of the time - and always around schools etc. (whilst being harassed by pretty much everyone else on the road)

The kind of nanny state attitude that is developing more and more in this country makes me feel physically sick, not all of us need to be told exactly how to behave all the time and what we can and can't do - we are given brains for a reason!

I suppose you think this poor chap deserves to loose his license and his job for a few seconds of stupidity - or maybe he thought it was a 40 - we don't know!

Good luck, go to court accept the point but get a letter from your manager etc to say you will not be able to continue with your job if you can't drive, they normally let you off with a bigger fine etc.

Who gives a about breaking the law? We live in a country thats waging an illegal war. If my government isn't going to obey the law I'm not too bothered about sticking to it myself. The UK is amongst the most unlawful and corruot nations in the westewrn world, IMO, so I'm ed if I'm going to tug my forelock and do as my masters bid.

And it IS hard sticking to the speed limits. Its bloody boring. I can't stay awake. You'd need to be brain dead to plod along at the limit all the time. I don't know how people do it.

Rules are for fools to follow and for wise men to ignore. Have a look at www.pepipoo.co.uk McMoss. You'll need a brief if you're looking at a ban.

He would have had to do it a number of times to lose his license and not just on this occasion.

We all know the rules, if people speed then it's their risk. If anyone is unaware of the speed limit on the bit of road they're on then they aren't paying enough attention.

If people don't like the speed limits then they should fight them. If they don't like the way they are enforced then they should fight that too. If anyone suddenly discovers this passion for 'justice' once they're faced with points then it's just self-interest.
