I picked up my admitidly old passat from a trader.

I checked the whole car out and it seemed fine. I checked the tax and there was a disc in the holder. I simply looked at the big number.

When I got home 48 hours later I noticed the tax was a full 4 months out of date and the old disk had been left on the car.

I rapidly swapped it for a new one, BUT the trader did not inform me of this and in my eyes let me drive away in a car which was unroadworthy.

I rang them up and said I was disapointed and they have not returned my calls. They said all cars they sell have expired tax discs and they do not include it in any of their deals.

Tax is not a lot of cash, and I have to say Ive glossed over the details here. But can I claim back for some tax and or claim that the car was unroadworthy etc. Normally Id not bother even trying but they were somewhat abusive over this and its put my back up.

Just looking for some advice here as to whether this should be reported and or followed up?

I wouldnt expect a car from a trader to be taxed, and I wouldnt even expect a trader to offer to get it taxed either, even if I was paying for it. I wouldnt expect a used car from a dealer to be taxed either, but they tend to ask you if you want it taxed for 6 or 12 months, do the paperwork for you and add it to the invoice.

Sadly I must agree with BG. They were probably behaving like dodgy misleading scum, but being car dealers that's par for the course.

It's up to the buyer to determine what's included in the sale and to check a car over thoroughly if its sold as seen without a warranty.

Think it works the other way round...you can't tax without insurance?

How is the dealer at fault for your lack of observation?

Did the dealer specifically state that it was taxed?

As for the unroadworthy thing the vehicle isn't unroadworthy without road tax, just untaxed. You are responsible for ensuring your vehicle whether only just purchased or not is fully compliant with the law not a car dealer.
