legal advice re E Bay
Discussion
I will try to keep this simple
I saw some reasonably priced shower cubicles on E bay, delivery was £47, so e mailed the company and they said I could collect [cost to me £20] ten days later I bought an enclosure and emailed them to say I would like to take up the advertised option of a tray to suit for £50, they replied that I could not collect as they had moved,
I said I was miffed at this because if I liked what I had bought I would have another at the same time as well as wanting to keep to budget.
they then said that local delivery could be undertaken eithr FOC or very cheap[£10] but as I was not local they would combine delivery charges if I bought another, I thought this was reasonable so I bought another again through E Bay this time the auction item included a tray.
All this took place over the Christmas period when there seemed to be a lot of companies moving excess stock at reasonable prices.
When they came back to work they invoiced me for the first enclosure and the second item that was an enclosure and tray included for one delivery charge as promised, but when I contacted them to point out that they had not included the extra tray at £50 they then said that I would have to pay £94 delivery as their carrier would only include 3 items for one fee my argument was that I have only purchased 3 items from them ie item 1= 1st enclosure item 2 =extra tray, item 3 = second enclosure inclusive of tray.
They confirmed my interpretation of this when they invoiced me initially for 2 items but omitted the 3rd [the extra tray].
Their attitude from then on has been appaling, I have bent over backwards to compromise, offer to collect at time off their choosing was rejected but they said I could send my own carrier, could they not have made an exception to solve this one off problem,? I then said ok you do a local delivery to just outside your premisses, or any other location of your choosing and I will meet you, again rejected out of hand,
They then said that they would not hold me to my contract to buy the goods , this would probably suit them as they have increased the price considerably since the new year.
They are now not responding to e mails
I feel that I do want to enforce the contract that we have.
If I go to small claims court what could I claim for

Female friend of mine has a VERY lucrative business selling cosmetics on Ebay.........a lipstick for example she sells for 99p starting price, if it makes 99p fine, she charges 1.99 for postage, packaging and postage cosets are under 50p............she makes a very small profit on the item and 150p on the postage............buyer beware, its EBAY

Couldn't your own carrier...have been you?
Having said that, do you really want to get involved with a company with such awful customer service? What if you get the enclosure home and it's scratched, or the tray's got a crack in it - can you imagine the nightmare you'd have then? I reckon you've had a lucky escape.

You often see this comment about postage costs on eBay and I've been uphappy at paying £5 for something that comes in a re-used jiffy bag with a 38p stamp on it, or people charging for recorded delivery and it turns up in the ordinary post.
However in your female friends case, if she really is doing this as a business then she has to value her time doing the handling and packing (even her time going and buying the packing materials), travelling to the post office etc etc.
If she works out her hourly rate then she'll probably wonder why she's bothering!
