This question is probably irrelevant with all the speed cameras about but if you get stopped by the BiB and they ask you "excuss me sir do you know the speed limit along this road" and lets say you were doing 39 in a 30, if you said with a straight face "Yes its 40 mph, why".
Is there a possibility that they would`nt take you to court because, yes you broke the speed limit but not knowingly.

Would`nt it be nice if you could.

I thought that ignorance of the law was no defence?

If you don't know the speed limit you probably weren't paying attention, you don't want to go there.

If he`s going to nick you anyway why does he ask you if you know what the speed limit is, is it some sort of legal requirement because once you`ve admitted you knew the limit, it makes booking you easier.
If Nick Freeman can get away with a loop-hole in the law then why not everybody else.

I'd guess it's the beginning of the "attitude check".

It is basically an opening question to catch you offguard which leads you into the next question where you admit you were speeding. This will mean that they will not have to have their evidence scrutinised. Sometimes they dont have any legally useful evidence at all.

Thoe other one is 'Do you know why you have been pulled over?' If you say yes, was it because I was speeding, you have also admitting it.

The other is 'Do you know how fast you were going?' Saying no makes you look negligent, and obviously if you say, yes sir, 80mph, you are also obviously stuffed.

However, if the last time you looked at your speedo you were not breaking the limit, and since that point you were concentrating on the road, conditions, hazards and traffic around you, I think that is fair enough.

How to get less grief:

1) Pull over asap

2) Turn off engine

3) Get out of car, taking keys with you

4) Stand on pavement

5) Be meek

6) Listen and be respectful

7) Be absolutely, totally, completely truthful

These simple steps have always served me well. When I was much less experienced I overtook someone on the zigzag bit of a pedestrian crossing. I got pulled for it and told him I didn't know it was an offence. He said he could do me for that, to which I replied "I'm just being honest mate", and he laughed and let me off with a verbal warning. Policemen are just human beings at the end of the day, you meet good ones and bad ones. I've yet to meet even a bad one who isn't disarmed by just being respectful.

A quick, "Go and check it for yourself you lazy bastard and stop wasting my time." will work wonders.

The sensible answer is that it is your job to observe such things.

Be surprised and answer with a polite question of your own such as

"What speed do you think I was doing" or "Why, do you think I was speeding"? Don't get cocky though or your tyres will get a kicking.

Polite responses -- even if you are going to deny the charge are the way forward. There's no point winding the bloke up so that he goes the extra mile to make your life misery (and he's on the clock).

Ultimately if in the back of your mind the thought is - "I respect you, but I'm not going to admit a crime to you", then it's going to be a lot easy for you and him to engage in the criminal justice process.

The more you can do to distinguish yourself from the drunken, abusive, annoying toerag that he pulled over ten minutes ago is going to be in your favour.

Cop"are you aware of the speed limit along this stretch of road sir?"

R"And you are"?

Cop "Erm we are the police"

R "Who sent you? This is a windup, you are that guy off Star trek arn't you?

Cop "No sir I am policeman"

R "I have a heart problem you know", "You've been told to follow me cos I am gay havn't you? Come on out with it, who was it?

And so on and so forth... There are lots of ways of confusing the issue without getting into direct conflict with the officer.

I answered the "How fast were you going?" question one night by saying " No idea mate".

The copper looked a bit confused and threw back "Well thats a cause for concern for a start, you were doing well over 100 we think".

Final retort went " Think what you like, i was watching the ROAD not the dammed speedo, thats a lot more important dont you think?".

At which point he went and had a chat with someone else....mutter mutter mutter and then let me on my way.......

"Do you know you were doing 80mph when you passed me?"

"yes"

"You realise that there is a 70mph limit?"

"yes"

"so what have you got to say"

"well, the thing is the last time I looked I was driving a car not a train. You are British transport police and the only ticket you can give me is a Super saver return. Now if you've finished wasting my time I'll carry on my way. Good night"
