BOX JUNCTION CAMERAS
Discussion
Just recieved a pcn relating to stopping on a box junction at charing cross rd.i was trapped by a taxi that stopped outside the pall mall club.my point is that when i started across the junction there was no indication that this taxi was going to stop,so can i be penalised for someone elses action?
The law says that you can sit in a box junction if you are turning right and are prevented from doing so by traffic coming towards you.

Schedule 19 Part II Traffic Sign and General Directions 2002
Prohibition conveyed by markings in diagram 1043 or 1044 (Yellow Box Junctions)
7. - (1) Except when placed in the circumstances described in paragraph 8, the road markings shown in diagrams 1043 and 1044 shall each convey the prohibition that no person shall cause a vehicle to enter the box junction so that the vehicle has to stop within the box junction due to the presence of stationary vehicles.
(2) The prohibition in sub-paragraph (1) does not apply to any person -
(a) who causes a vehicle to enter the box junction (other than a box junction at a roundabout) for the purpose of turning right; AND
(b) stops it within the box junction for so long as it is prevented from completing the right turn by oncoming vehicles or other vehicles which are stationary whilst waiting to complete a right turn.
So on that it would appear down the Swanee. However as these things are on the all seeing eye of the camera if the circumstances are as stated, taxi mixes following driver a bottle i.e. no signal until last moment and stops then there may be an argument beyond the control of the following driver and as such may be worth an appeal. Procedure should be outlined on the pcn.

We have been told that unless our vehicles have Blue lights etc on then the driver will have to pay any ticket that may be issued.
Whilst some of you might jump on the high moral ground here, sometimes people do get caught out on the box junction by a variety of reasons. Im not talking about being slap bang in the middle but half a car either way where theres no obstruction caused but it still is an embarassment to the driver.
I know for a fact that the local authority will prosecute for even a minor infringement so everyone had better be careful and concentrate 100%.

London boroughs have announced a "get tough" policy on YBJs. Many reports suggest that Ken's Bendy-buses are one of the major issues today, with their drivers ignoring (or forgetting) that they are some 18m long. As a consequence, their back "half" blocks YBJs and other junctions (sometimes because the bus-stops have not been relocated to accommodate the increased length).
But what's the betting that the "bendys" won't be ticketed when caught on camera?
