Bought a car from a small independant dealer yesterday with the promise of 6 months tax. On collection the guy had not managed to tax the car but knocked the price down accordingly. Insurance was arranged the day before (they faxed a cover note through) and the MOT does not expire until November this year. The origional insurance certificate was promised on a next day delivery.

Went down to the Post Office this morning to try and tax the car with the faxed cover note as the origional had not arrived. The Post Office would not accept the fax as proof of insurance. Phoned the local DVLA office who were pretty unhelpfull - they told me to keep the car off the public road untill the insurance document arrives which isn't really an option due to the office/work location. The dealer cannot help now as the V5 has been posted so he cannot tax the car under his insurance.

Where do I stand if pulled by the BiB? I am driving in the Medway area, apparently it is covered by the anpr cameras which is worrying. Also as I bought the car on the 31/01/06 will I have to back date the tax to the 01/01 to remain within the law?

What really annoys me is that I am trying to comply with the rules but cannot. My MOT and tax could expire tomorrow but I could still tax the car for a year. Why is this the case? I know I should not have accepted the car until it was taxed but circumstances dictated that I take the car yesterday.

Very Frustrating!!!!!

Do you have the MOT? Is it the new style one? If so, you may be able to arrange tax online.

When you bought the car the seller would retain the majority of the V5 and send off to DVLA handing you the New Keeper Supplement (VSC/2). According to DVLA using this form with Form V10 (from Post Office) and current original Insurance and Test Certificate, as I understand it, you should be able to licence the vehicle.

But, I understand that GPO are not happy with Cover Notes/Photocopies as it doesn't automatically mean that the vehicle is insured of which they want to be satisfied about.

What happen when stoppped by BiB for no excise licence (revenue not a Police type offence) he has to send off a form to DVLA reporting the unlicensed use and it is them, not the Police or CPS, that can authorise a prosecution. The trick in using a vehicle after old licence has expired is to get it licensed as soon as possible. It is often wrongly thought that there is a 14 day grace period, but administratively this seems to exist to allow DVLA records to be updated. So if stopped on 2.2.06 and re-licensed say 10.2.06 then by time Plods report is received and processed by DVLA there is s strong chance that their records should show no evasion of duty.

Having said that there is no escape from the offence of failing to display a current Licence for which BiB can take action by FPN.

Regarding use on 31.1.06 if the vehicle has not been licensed for that month then duty will have to be paid for the full month. Bear in mind it is a very serious offence to make a false declaration to obtain a Licence, the question of useage could form part of that declaration.

Why the Post Office is barred from issuing say a 14 day temporary Licence to allow a person to use a car legally from the off beats me.

I got pulled literally 2 minutes after buying my car. Explained the situation to the officer and he sent me on my way with a chuckle.

Got it taxed the following day.

For once I can answer one of your questions DvD The gf has started working in a post office this week and they are explicitly trained to only accept an original CERTIFICATE of insurance. Nothing else will do. I had it drilled into me on Monday evening

Not that I would condone it but certificates are all just black and white prints any way. Photo shop is good at removing the fax headers.

I purchased a car in december and checked the tax on the car. it looked ok. Dealer said whatever was on it I could keep. It looked like 10 months to me.

When I got home I noticed it was a year out of date.

Buggers had pulled a fast one. I will always check this in future.

Deeply anoyed

You wont be able to do this if the Insurance has recently been purchased.

Yep, back in my motor trade days, we would have the odd problem at the PO with a genuine document, and I mean a genuine document, but for whatever reason it was jobsworths day. So we would run up a false document and use that, it would always amaze me the way they would reject the genuine, but accept the false, just because it ticked all the boxes.

The last time I bought tax the jobsworth in the post office did not want to give me the tax disc because she said the insurance certificate looked like it had just come off a printer. I assured her that it was exactly how it had arrived through my letter box, and it propably had come off a printer, but in their ( ins comp ) office, not my house. She refused, I asked for the manager. He sided with her. Eventualy, after phoning the insurence company, and getting them to speak to the post office staff, I could have my tax disc. I would have been buggered on a Saturday. The P.O. manager made my laugh by suggesting that if I came in with a similar document again, I should have a letter from the ins comp stating the certificate was genuine. Surely, if it wasn't, my letter wouldn't be iether!! Doing it on line seems attractive, but how accurate / up to date will the data base be?

Managed to tax the car this morning. My previous employer had a blanket third party f&t policy for all employers cars. The contract you were working on picked up the cost of any damage to the employees car. As a result the insurance certificates did not carry vehicle or personal details. As I have just changed jobs I still had one of these certificates and managed to use this instead.

SO from not allowing me to tax the car with an faxed insurance document complete with details they accept an insurance certificate with no name or car details. I cannot understand the logic behind this.

When renewing tax discs before they used to ask for a headed letter together with the company's certificate however the same lady at the same post office served me today with no letter. Perhaps she just wanted to get me out of the post office!!

BTW I tried the photoshop editing yesterday - quite pleased with the results but it was not up to being scrutinised too closely!!!
