On New Years Day my car was flashed in the temporary 50 limit on the M4 at junction 8/9. It being 0659 on New Years morning, it was clearly important to enforce the limit for the safety of the workforce, but that’s another matter…
.
My son was driving and, when the form came through, I returned it naming him as the driver and giving his new address (he moved into his own place just before Christmas)
Today, a familiar-looking letter arrived from the Thames Valley Cash Machine at Banbury arrived on my doorstep, addressed to “the lad.” Presumably they have used the address recorded by DVLA, rather than the new address I gave them.
As I have given them the information they require, then I am “in the clear.” However, have any loopholes or technicalities opened up for my son? Could I simply send the letter back marked “no longer at this address” and leave them to look again at the form I sent them (and would this open up any loopholes about serving notice within 14 days?) or would DVLA do him for not keeping their records up-to-date?
Any advice would be appreciated

From what i have been told, you cannot be banned for a straight forward exceeding the speed limit in a temporary speed restriction area. Obviously don;t take this as read, but if you think this may be a possibility then you should do as much as you can to 'get away' with the situation.
On the flip side, you make no attempt to suggest that he may not have been doing what he has been accused of. So you have to help him avoid taking responsibilty for breaking the law or not. That's up to you, and I have to say I have no idea what I would do!
Oh and I apoligise for my pissed up over moralistic answer!

RS1952 as Reg Keeper served with NOIP re alleged incident within 14 days so good service and SCP can take time to chase driver. They have a name so could lay information within 6 months and take as lonmg as they like.
RS1952 has named son as driver signed form and returned S172 request so has complied and is totally in the clear of anything.

SCP have to chase up son to serve 172 form on him and have done so. Serice under the section includes last known address. That of RS1952 could it be known as such as a home address? Nevertheless faced with a non response SCP could well initiate proceedings for failing to complete 172 form. Bear in mind they have information that RS1952 has information as to who was the driver and if they go ahead will be refreshing their minds on reluctand witness and serviving witness summons for RS1952 to appear at Court to give evidence on what he put on the 172 form.
It could well be that faced with a non reply they will re=check the case papers and discover their error and send to the address RS1952 supplied.
Regret there does not seem to be any light at the end of the tunnel...
