Pretty fed up as I have just received a fine for a vehicle I no longer own and have not done so since last year. Sent the slip to the DVLA when I traded the car and thought that was that. Now got the normal £40 plus arears of duty to pay.
I have written to them but them and said that vehicle was traded, car is on a dealers website and has been since December and that I object to being treated like a criminal, but have just noticed that if I dont make the payment I get another £40 added to the fine by the end of the month.
I totally object to this highway robbery and am inclined to go to Court. What's my chances of winning? Will they take it this far? I can afford the fine but it's really a matter of princple now. I have never ever not paid my RFL, but I am certainly not paying it for a car I dont own.

Do you keep vehicle documents together in one place? If so it might be worth hunting for a piece of paper you might have forgotten you had - if they were in use at the time you disposed (I think so). Mine has V955 at the bottom and says "Thank you for telling us that you are no longer the keeper of or have scrapped the vehicle with the above mentioned registration mark. I can confirm we have updated our records."
This was last year as well, so maybe you have something from their own hand tucked away that will help you?
Even if the dealer didn;t send their slip in, if you did, this might have come back.
Good luck.

I will look. I know I got one back when the Griff went last year, but not sure the same is true when the Porsche was traded. The form went in over the Xmas break and I did wonder if the Postal service had done it's worst.
I am fairly p***ed off at the dealer for failing to do their bit, but given I would'nt let them fix a wonky wheelbarrow the level of their incompetence never ceases to underwhelm me (but that's another story!).

I had similar thing when I sold the 'teg to a dealership - but all I got was a reminder c.3-months after sale. Phoned DVLA, explained situation, they said 'write in and confirm to us when it was sold and to who'.
I did, then phoned and got confirmation they'd received my letter. Heard nothing more after that. I was told by them it was my responsibility to send the small bit back, they couldn't have cared less that the dealer had specifically instructed me not to!

I got a speeding fine years ago after I sold a car. I just wrote back and said I was no longer the keeper of the vehicle, and gave them the date I sent them back the paperwork. Never heard any more from them after that. Why not just give them the facts and let them investigate? If the dealer has the car on his website, so much the better - there's evidence that you don't own the car any more. And presumably the dealer gave you money or a part ex for it? Have you still got the paperwork on that?
Thanks DVD. I value your wisdom.
I'm so fed up with the totalitarian state we seem to be moving to that I am starting to make a stand for what I feel are my rights.
The sooner normal members of the public push back, the quicker this Govt will realise we wont be treated this way. If we were French we would have burnt the cameras and blocked the roads by now.
I always thought the UK was a good country to live in, now I realise that unless you are some limp lefty in a Govt 'non' job you have no future. I will be retiring abroad and taking my accumulated wealth with me and Gordon Brown can go and whistle for his considerable taxes he could have collected from me.
Climbs off soapbox!

Only way out with this Basst Se if you have a proof of posting from post office.
Take this from me if you ever send a v5 or driving licence anything to DVLA get proof of posting, sometimes you may have a mate that has one that the date mite fit,
No address on proof of posting and it is free; if you photocopy it and a letter it always works YOU ONLY NEED THE POSTCODE ON THE PROOF and it is all the same one, hope this helps

I don't understand this any more.
I've had fine "threats" from DVLA before, and have had to go out of my way to prove my innocence, rather than the DVLA proving my guilt.
The reality is you no longer own the car, you'll likely have a bank record of the money taken from the dealer you sold it to, and the fact that no one will find it in your posession, and find it at the dealership who cashed your cheque months ago!
They can't PROVE you own the car if you don't, that would defy logic. You did everything required of you, and responded with calls and a letter, so what more do they want? They can't prove something that doesn't exist (you owning the car), so just realise that a few hundred quid of your taxes is being wasted chasing you for the money someone else owes because they can't be arsed to do their own job!
PS: I send all DVLA stuff special delivery these days. Expensive yes, but if you can prove they got it, then you have no problems proving they have failed to administrate the required paperwork. Then you can laugh at them when you recieve threats like this because they haven't got a leg to stand on.
Quite amusing really that in a way a threat doesn't receive the same response that being nice would. If they'd sent a nice letter they'd get more worthy response than ignorance which is the way it's going!

Don't pay as yet.
See what the response to your letter will be.
I would suspect that it will be favourable.

DVD is right. I gave them the exact website address of the dealed who was selling my car with photos of the number plate. They wrote back after a few weeks telling me that they were not pursuing me any more.
While you're here, DVD you might be able to help me out.
I'm likely to be out of the country (with my car) when the reminder drops onto the doormat and will be so until after the renewal is due.
Now presumably I do not need tax until I'm back in the country anyway - but I can easily image the DVLA kicking up a fuss. There's also the question about what happens if I get stopped or zapped on the way home.
Do you have any thoughts?

Been mentioned before.
I take it you do not believe in swelling the coffers of HMG by paying Excise duty whilst the vehicle is out of the county. But beware, and also I am not au fait with other countries regs of vehicle taxation i.e. if you run as a visitor to their fair lands with UK duty unpaid do they sting you for no tax or similar in their land?
Remember that vehicles are exempt from duty if they are travelling to a pre arranged MOT station................off the boat and towards home and that test booked before you leave. It has not been decided at High Court as yet just what distance is allowed....., or
Get off the boat without Excise and Licence at the very first opportunity re-license at PO of DVLA Office. If stopped by time DVLA have to check their record to authorise a prosecution, your remittance will have received. Keep evidence that you have been out of the country.
On the first one they cannot slap a fail to display a current Licence but they can on the second.

Worth a note in the diary to check that the paperwork has come back.
