Hi All,

About 4 months ago my brother was involved in an accident where another driver misjudged a passing place in a country lane and hit my (stationary) brother. The guy (tourist) admitted fault at the time but retracted it & lied in his statement - he seems a bit of a nasty piece of work. At least no-one was injured.

As there were no witnesses the claim was settled knock for knock although knowing the road well & judging by the pics of the skid marks on the road from the other driver, it appears that the other guy is likely to have most of the responsibility for the crash.

This morning my brother (in Devon) got a summon for a court appearance this afternoon (in Sheffield). The letter was franked 2 weeks ago but arrived this am. He got on the phone to the court & managed to sort it for the time being.

It turns out the other parties insurers are trying to recover their costs by taking my bro to court, despite the fact that he's not got £250 to his name.

Apparently they are not happy that he was barefoot when driving (he rarely wears shoes anyway) but it was OK for them at the time. He has spoke to his insurers who will pick it up on his legal cover but he's bricking it to say the least.

Has anyone been in this situation or have any useful info I can pass on to him to reassure (or forewarn) him?

Cheers.

it seems a fairly normal thing nowadays! what happens is your insurance company ignores the third party insurance`s demands for payment,or acceptance of liability,so issues you a summons to force a reply.when it happened to me,i rang our company and never heard anything again.interestingly, even though my accident was more my fault,i had no claim logged against me,so whoever negotiated the claim obviously did a good job! tell him to pass it on to his insurance and forget about it.
