Just received NIP today for exceeding 50mph on M62 westbound Liverpool,I am the owner and keeper, but not the driver, there were three others in vehicle at time and I was asleep after long journey from North Scotland often stuck in traffic,my point being the individual who was driving when I woke was not the same as when I fell asleep, and as no one even knew we had been flashed or even where until today cant tell who driver was, final destination was cardiff a fair distance from M62.What is my next step. thanks.

If were on the M62 you were going the wrong way... you should have stayed on the M6.
However if it is the ones I know about just outside Warrington I think I know the area. As far as i am aware the siting of the camera etc is kosher, they are avarage speed ones and they dont flash or give you a warning. Every so often someone would go flying past me at 80 and I always wondered if they knew... and what happened to them!
Anyway though, you can respond to the letter by just telling the truth, give the names and information of the other drivers. However if they were not insured to drive at that time you may be letting yourselves into a lot more trouble. 82 in a 50 I believe is court territory so I would get your stories straight as one or all of you may need a trip down to Warrington Mags Court or wherever Cheshire use...

As the RK you have to do all you can to ID the driver at the time. First step would be to request pics to help you ID the driver. If they don't help and none of the possible drivers will 'fess up then you'll just have to name them all and explain why you can't say for sure who it was.
The scammers will either believe you and drop it or summons you to explain to the Magistrates who will either believe you or not...
Would the other possible drivers be willing to provide statements saying they are certain it wasn't you? If they are that makes your job a lot easier.
