I've just arrived home after being pulled over by the police on the M4, having clocked 110mph. I've been told I'll get a summons and magistrates appearance and - having quickly scanned the internet - I'm expecting a ban of some sort. However, what kind of fine can I expect to accompany the ban? I understand there are 5 levels of fine, but I'm not sure how they're given out. Does anyone have insight into this?

Cheers

www.pepipoo.com is the place for this. As far as fines are concerned, they are related to income so if you do receive a summons and a means form make sure you are poor when you fill it in.

Speeding on a motorway is a level 4 fine & 3-6points , discretionary disqualification.

Level 4 fine maximum is £2500 , but the actual amount is not likely to be close to the maximum in most cases.
It will be set by the court with due regard to all the circumstances of the case & within your ability to pay.

Ouch! Thanks guys - here's hoping they don't go for a ban, although I guess it's more than likely.

Same happened to me in January 2005, pulled over after an amazing date with a gorgeous woman! 106mph average, 105mph given to me in court as part of a 'driving without due care' thang. Went to court ten months later, got 8 points, on top of my original 3 - plus £400.

With 11 points I now have to drive round like my mothers sitting in the car...bad luck mate, recommend you write everything down to remember it, ask for advice on Pepipoo and plead guilty. I just hope the copper who pulled you didn't lie in his statement, mine said I was pulling away from him in a 2 litre normally aspirated Fiat, he was in a 3 litre BMW!

Good luck though.

My Dad got a 2 week ban and a £500 fine for 100mph on the M4 a few years back.

The more you earn the more you pay (but you get a shorter ban)

I suspect you'll get some sort of ban, but I can't say what (I assume you weren't in the Tranny from your profile pic?! )

It might be worth having a chat with a specialist motoring solicitor if you are interested in minimising any punishment you receive if convicted - many do a free initial half hour conversation - or you could try the CAB.

Yeah it definitely wasn't the Transit - that has only ever hit 90mph downhill with the wind behind it!

Apparently I was doing 120mph, but they only clocked 110mph - not bad for a Seat Leon TDi, but too quick at the end of the day..

10 years clean license, or 10 years un-detected crime?. You asked for advice!, may I suggest you read the highway code and refresh your memory a little.

I am not critisizing your driving ability, but you guys just bring a smile to my face, we all know the NSL, abuse it, and its your license in jeapody.

Bet you wont do that again in a hurry. And I do hope the find is minimal, getting caught and points is deterrent enough.

Of course - that will be invaluable advice, I'm off to read mine now as well, the Bank Holiday can wait.

Yes, after that arbitrary enforcement of a technical regulation, and then reading your post, he'll change for ever - I'm considering the priesthood.

Me too, no ban and a moderate fine would be great. But no, it's not deterrent enough, it's almost always criminalisation of safe driving and that's a disgrace.

Well that sure did bring a smile to my face!

I do accept that it was my decision to drive that fast and my fault for getting caught, so at the end of the day I've got to accept the consequences. However, Turbobloke is right - the motorway speed limit is outdated and I do think it is a waste of police and magistrates time (and our tax money), to follow this kind of thing through.

What really pisses me off is the fact that, in my experience, when REAL crimes happen the police don't have a clue. A friend of mine experienced a serious assault a few years ago, then my house was burgled a couple of years later and on both ocassions the police ultimately did nothing except issue crime numbers.

Oh well, at least they made the effort to get in a patrol car and catch me rather than setting up another bloody Gatso..

Rant over!

Its because as car enthusiastists we are easy pickings and police have to meet their targets. Thats what I think anyway, maybe my view is distorted by the fact I am facing a ban and I have witnessed many incidences of police dangerous driving.

Have to gree with most of your points lads, and definately that motorway limits are too low, but its your choice to take a chance, yes we are easy and soft targets, and sadly nothing will change that attitude at the moment.

Trouble is if you break the law, they will punish you, with the likes of house breakers, muggers, murderers, it takes time to be brought to court, and proven beyond all reasonable doubt the crime was committed by Joe Bloggs, with a motorist, uaually the photo is indisputable proof, (unfortunately), Just be careful out there.

P.S. For whats its worth, just thought I would add this comment. A couple of years ago, I was working out of Dubai, due back in time for my sons graduation in Carlisle on a Saturday morning. Got delayed getting home, landed in Glasgow early Saturday. I had a choice, hire a car, drive down and stick to 70 and possible miss the graduation, or exceed it with the thought that a) I habitually do not exceed NSL's, b) I only drive on the roads about 6 months of theyear, and c) have never had a ticket for exceeding set speed limits, so I can take my chance, and go faster, if I am caught, OK, I will get fined and points, and make no bones about it, but may make my sons graduation.

So I drove down the M74 most of the way at a steady ton. Saturday morning very light traffice, BUT I was fully aware that if I got caught, I would pay the price.

So yes I agree with most of your points, but can only reiterate you take your chances if you exceed NSL, I definately do not support the thought that speed kills, bad driving, tiredness, lack of due care and attention are the major contributing factors arnt they? and of course just plain stupidity on our roads.

Just a thought or two about your post there Colin:

If in normal circumstances you hardly ever exceed the NSL, is it wise to drive an appreciable distance at 100 mph as a one-off sort of thing? Obviously no harm resulted and you didn't get caught and penalised for it, which is good in my book.

All I'm thinking is that the situation with NSL type speeding is that - if we do it at all - it is best for it to be practiced regularly is it not?

Best wishes all,
Dave.

Bench guidelines are 40 over a 70 limit attracts a level B fine (one week's take home pay) upto £2,500 and 6pts/56 days ban. Aggravating / mitigating factors can move this up and down, and a plea of exceptional hardship (ie your boss saying in writing his business will suffer and you'll lose your job if you are banned) might sway towards points rather than a ban.

Additionally, an early guilty plea should save you a third off the regualr price.

Hmmm, interesting. Not sure I have any mitigating or aggravating circumstances. Do I need a solicitor or would it be fine to just turn up, plead guilty and be done with it?
