Just received one of these from Lambeth Council. They give you a website address to view "additional photos of the contravention" which do show me stopped ( i stopped to answer a mobile phone call-no hands free) on a single yellow line yet I never left the car. The "contravention pictures (3x) show me stationary for 24 seconds elapsed time. I am visible in the car. Any guidance guys and gals?

-Is it legit for a cctv camera that you dont know is there to issue tickets?
is this a legal use of CCTV cameras?
-Am I allowed to stop to take a mobile phone call? otherwise I would get nicked for using it on the move (got you both ways)
-Just how long can you stop before getting nicked? for example my sat-nav came unstuck from the window and fell down. I had to stop and sort this out (its a wired one with lots of cables ) and could have got a ticket for that!

Strikes me that this is anothother revenue earner for local councils since parking became decriminalised

Comments? advice? PLEASE!

What offence have they told you that you have contravined?

I though it was only an offence to stop on red routes.

Surely pulling up for 30 seconds on a single yellow does not constitute parking.

Yellow line denotes a "Waiting Restriction" note the word waiting and not parking.

Traffic Regulation Order for that mentioned may or may not contain what and reason for stopping that is allowed i.e. dropping off/picking up, loading/unloading. Taking a mobile phone call or making one will not feature.

Transport for London (Consequential Provisions) Order 2005 which came in 14th February 2005 allows T4L to issue Penalty Charge Notices for such offences detected by CCTV.In the old days PCN had to be given to driver or stuck on the vehicle.

You could write in to explain why you stopped. The letter may hit a compassionate heart but don't bank on it.

By the way if not paid with a certain time penalty will be increased dramatically.

I agree with all DVD has posted - unfortunately TfL has set about this purely as a revenue earner and it all allowed

but

Are there not laws stating that signs must be visible indicating that you are being recorded on cctv etc etc...?

iirc you used to be allowed 2 mins for dropping off or picking someone up but that was years ago, come to think of it you were also allowed to break down on yellow lines

So what if you blew a fuse and had to check the fuse board because the ignition cut out? Surely that would be a temporary breakdown. You would have had to find the fuse and change it to get going again. If my engine failed I'd make them work really hard before handing over my wedge.

Parking, waiting or kerb crawling, they're spoilt for choice.

They have said that this is contravention 02 "parked or loading in a restricted street where waiting and unloading and loading/unloading restrictions are in force" it was a single yellow and I never left the car .
However I can call a number to arrange to see the video evidence. In Lambeth id expect, thats about 10 quid of fuel to round trip that one, plus my time.

I dont think that there are any warning signs saying that you are being watched by CCTV, I assume then that they have to do that.

If I was sitting in my car on a mobile and a ward (sorry parking attendant!) came along, he wouldnt slap a ticket on me would he? Suppose I had a medical condition like Asthmatic and had to stop to use an inhaler, i'd get a £50 ticket, so I would too if my car stalled. Thats not right at all.

They just want to to pay up £50 and shutup-well i wont on this. Its an infringement of my human rights-always worth a crack that one

The French would never accept some of the crazy rules that have popped up in this country. We put up with it and just moan a bit. Time we do what the French do and stand up to the idiots in charge. Anyone got any trucks to park in Lambeth ? ( If enough people stood up then we could get something done before they barcode your loo seat and charge you for a s*** )

You were waiting, weren't you? It does seem harsh, however, to enforce this so rigidly. If you had developed a mechanical problem, or something else out of the control of the driver, then you would have had a good defence. You could have had 20 mins to load you car (provided you left as soon as loading was complete). And you could have picked up or set down passengers.

No it's not. But you might feel hard-done-by. Lambeth roll over like puppies when you complain (it will take them about 6 months to reply to you, however), so I suggest you get a letter into them pronto. Something which supports the fact that you were allowed to be there would be ideal.

Someone I know got done in Wandsworth for this they were lost and he parked up on a yellow line, his son went into a shop for directions. They sent him video evidence and you could see his son walking up and down the road!
Silly thing is he was towing a car on a tailor so he didn't have many places he could stop. Anyway he entered into a long battle of writing letters and told them he had stopped to let the engine cool down as it had over heated, eventually they dropped it! Well he thinks so as he hasn't heard anything from them in several months!

Me? Well I thought I'd take on Westminster and chickened out when it got to £150. I just avoid that place now! Refuse to work there.
