Well, I've now got the fourteen day wait to see if I've still got a clean license. Coming out of Heath&Reach today, heading towards the A5. In a 30 limit, pull out onto "wrong side" and pass a van that is stopping at the roadside, and run straight into the cross-hairs of a camera van. Glance down and see that I'm pulling about 2200-2300rpm. Gear&diff ratios suggest that this is 33.7-35.3mph (My speedo decided today was the day to behave erratically).
Will have to see what/if they got me at.
Thing is, to my mind, 'tis better to get past an obstruction as quickly as possible, but of course I'll just be another statistic at the end of the day. And of course, the guy behind who was arguing with his passenger, talking on his phone and throwing rubbish ouf of his car will not be done for anything!

dont think faulty speedo carries points
and as you had no speedo you had not intended to break the speed limit

Speeding is a 'strict liability' offence - the prosecution is not required to prove mens rea (= "guilty mind" ).

Beat me to it.
<devils advocate> So you think it was better to accelerate around a hazard than wait for a better view (after it pulled off the road)?

Further info from a 928 source suggests that 2300rpm is 33.5 tops for my car (My manual has the wrong ratios!!). Hopefully that is below the Beds minimum (and hopefully my rev counter is accurate, the operator didn't catch me at a high rev etc). I know for a fact that he caught the previous car to pass him (one in front of me), because he was pulling away from me as I appraoched the van. I'm only hoping it was his details the operator was noting as I passed the van, and not that he was writing mine down too.
It's also been suggested that the front of the 928 is tough to get a reading back from. Does anyone know whether this is true?

Actually I could see the road quite clearly, I couldn't see the camera van parked off the road (on my side of the road) and nearly out of sight until I had essentially commited to the manoeuvre.jasandjules said:
Wouldn't driving with a faulty speedo be an offence? Not a defence I would want to run in front the of the bench. I would pay the taxman his £60.
Not sure it is actually an offense, but certainly I'd not try to use it as an excuse (incase it is!). At the end of the day, it would be the first points I've gained, and not worth fighting (doesn't mean I won't string them along for a bit though
)Goodness me! You're only talking about 33.5mph!! I'm sure everyone here would be gobsmacked if you were fined for that! Everyone does 33.5mph in a 30 limit sometimes.
OK, so let's wait 14 days to see if your local Partnership is now fining people for speeds below the official prosecution threshold.....

I did start off with thinking I was just over 35mph, so started the thread. Email advice has suggest a slightly slower speed BUT is dependent on my rev counter being accurate. A few rpm more sees me over 35 and then definately in the cross-hairs because I'm potentially just another killer
Actually what annoys me about this is that from where I was, I could clearly see all possible hazards that would need me to alter speed or course except the camera van parked five foot off the road and thiry yards before the nsl signs (The van I pulled out past blocked the view of that particular hazard).

Surely 10% +2 is 35mph REAL before they prosecute you, and there is no way a car over reads naturally anyway, so chances are your car for whatever reason was probably doing a little less than that.
The reality is worst case you were doing a REAL 33.5mph tops, but probably due to lower rolling radius tyres on the drive wheels (accelerating??) and tyre wear.
I doubt they'll be doing you for what is probably 31 or 32mph, that would just be CRAZY! Actually, expect a NIP for 31mph then

)Thats the problem, it costs more to fight than to pay, thats why the thieving taxing B'stards get away with it. I know its not my money, but please spend the extra £30 or so by letting it go to court (and plead guilty) just to block up the system a bit. If we all did this, just for a couple of weeks the whole fine for tax system would break down.
