Unadopted road - Public Highway?
Discussion
Something for the legal eagles and the Informed.
I live on a stretch of un-adopted road - not a private road - which is regularly used as a 'public highway' by traffic using it for access to adopted roads, and as a short-cut.
It is also used by folk who parked untaxed vehicles, and has been for a long time. They have been challenged but always maintain that the vehicles are not on the highway for tax purposes and SORN applies.
The road has clearly defined pavements, street lighting and is partially tarmaced, at the residents' expense.
Anyone know the facts??
cheers
Jeff

The definition of a road under the Road Traffic Act 1988 (insurance, drink drive, driving offences etc) is different from the defintion under the Vehicle Excise and Registration Act 1994 (vehicle licence offences)
A road under the RTA 1988 is one to which the public have access.
A road under the VE&RA 1994 is one repairable at public expense.
