Not sure if this is the right place to post this so preparing to see it moved...

Does anyone know what the property inheritance laws are in France?

The future Mrs Richie's pater owns a little place in Brittany and we were discussing what would happend to the property should said aged parent shuffle off this mortal coil.

We're not sure if he and SWMBO's step-mum own it jointly or if it's just in his name, which may, or may not, complicate things. I had some vague notion that there was something about all the children of the owner getting a share but I'm probably wrong.

Not 100% but I think any Brit who owns property/land in France needs a will both here AND there. Will check...

Well, it's not the best citation in the world ever (volume 62), but www.frenchpropertyservice.com/frenchpropertyOwnershipandinheritancelawFAQ.html#question221 seems to suggest that an English will is inapplicable in France, so anyone owning property there should write a French will (see a lawyer who specialises in specialist wills and probate), and also review their English will at the same time.

Hope that helps!
Tigger.

As far as wills go, you can make arrangements similar to those possible in the UK for most matters except property.

French inheritance law for property is still under the old 'napoleonic' rules where there are priority inheritors (children, brothers, sisters, parents etc and the partner usually last...

If they are married, you need to know under what legal regime. If there was no premarriage contract then it may be considered under the generic sharing of good principle.

You shouldnt have too much trouble to locate an English speaking French notaire to explain exactly what will happen in this case.

I think that's right, but then it can get very complicated when the next generation of owners either want to sell or themselves start shuffling off this mortal coil. As you suspect, now is the time to get everything arranged in black & white so as to avoid lots of future complication and expense.

There is something about if there are "N" offspring, then each of them must get 1/(N-1) of the total...but I'm sure of the detail, again that's mentioned on the site I mentioned previously.
