My flat mate parked my car on a single yellow line on Friday night and didn’t tell me about it. Parking restrictions came into play on the Saturday morning at 7am . My car was ticketed at about 8 .30 and it was removed by Westminster city council at 11.am It was parked on a wide straight road far away from junctions etc, I don’t believe it was causing an obstruction. The ticket was 50 quid then toe away 150 !

What the chance I can appeal and get my £150 back from the council?
cheers

p.s where's the speed plot and law section gone from PH ?

The car is your responsibility. Personally I think your mate should be very embarrased, and be putting his hand in his pocket without hesitation.

As above, seems that the car was caught bang to rights (can you argue with that)?

Now, the question is why is your flatmate moving your care without you knowing, was he insured, etc?

Unfortunately not.

The only ground that comes anywhere near is ( RTA 91 )that the vehicle had been permitted to remain at rest in the parking place by a person who was in control of the vehicle without the consent of the owner.

Dob your mate and get him a lifetime record for crime of TWLA.

Whilst under the law of parking the Reg Keeper is ultimately held to be responsible for infirngements involving his vehicle I would be seeking moolah from the friend as suggested.

The above case is interesting.

He moved the car as he uses the our underground space on the weekend. He was lazy and parked on a main road instead of a residents bay. He then left me a note for me to remove the car when i came back from the pub or in the morning ... the note blew away !
So i would have had to move the car either pissed or at 6.30 am ! nice mate eh !
He's refusing to pay the fine !

There you go then, looks like your flat mate has a simple choice £150 or charge of TWLA (not sure what this stands for btw, thought it would be TWOC).

Tell him to pay up, or at least get him to pay half in the interests of mate-dom...

Needless to say he's no longer a mate. Anyway best not discuss it here too much just in case he reads PH . With my login name it wont be hard to guess !

Before you totally fall out with yr ex-mate it has been suggested that you could consider 'selling' him your car as you agreed last Friday morning. You could send in the paperwork. Advise the parking mob that your mate is now RK and deal with him. Later your mate could find that hit with an unexpected £ 200 to shell out he cannot afford to make the final payment on the deal he might have to ask you to buy the car back. When you agree in a week or so's time and you have the new paperwork then you agree to transfer it back. Since your mate was RK when the problem happened, the problem stays with him.

How is this going to work?

If his flatmate won't just pay the £200, he's not going to go through this one is he?

I couldn't figure that one out either .. too late anyway the slagging match already started today. I wish i never let him move in , would have saved a fortune ! He slept in on monday so i got another ticket as i was surposed to park in the flat space when he went to work .. he's not paying for either ticket .. unbeleavable !
