Likely Outcome ?
Discussion
Being in a van can make little difference (depending on the size). A mate got done in a truck (fully ladden 32tons) and got 3 points but a bigger fine as the danger of 32 tons at 40 in a 30 is much greater than a Fiat Panda doing the same speed. One will stop if it hits a leaf on the road the other will pass through your house without slowing.

By van do you mean AstraMax-car-style or Mercedes-LWB-Sprinter-LGV-style?
Shouldn't make a difference, but obviously speeding in a larger vehicle is more dangerous, so could maybe be taken as aggravation.
Typically, offences upto 25mph over the limit are dealt with by issuing a fixed penalty notice (£60 and 3 points), and over Limit+25mph are given a summons (bad look there). As it's just over the fixed penalty threshold, it'll probably just be dealt with as exceeding the statutory speed limit, I doubt they're try bringing careless driving.
If so it's 3 to 6 points, and a comparable fine. (See www.dvla.gov.uk/drivers/endorsem.htm#7.%20Endorsement%20Offence%20Codes for details).

It's for the company to nominate the driver at the time. (Nominate? Name).
Had a similar thing with a client a few years ago. They claimed not to know who was driving at the time (in fact, they knew full well). One of the local BiB's rolled up with a smile and a photo of their MD at the wheel. He suggested that it might jog their memory.
Please, don't take this course of action if you know full well. If there's an offer, accept the £30 tax and take your points.

Yes they can as the company ist registered keeper. You complete form und name driver. They then send NIP to named driver with the menaces to own up or else.
If company fail to nominate.. I am sure lieber von will leap up und down und correct if incorrect
... but I seem to think I read somewhere that they can award the points to the company secretary or someone "official". I may have remembered wrong or it may be "urban myth"... Und ist £60 fine und three points if fixed offer.
On licence for 4 years - declarable for 3 years und 5 years in case of insurers.

Sorry Gordski,
completely untrue.
A 32 tonner has the most awesome stopping power.
The tyre contact area per ton and the number of braking components are far greater than any car made.
In the wet the sheer weight of the vehicle forces the water out from under the tread and the vehicle stops very quickly indeed, whereas a car, particularly a light one, will instantly aquaplane.
The judge that handed him that sentence needs to be educated, as does the average lawyer in the same manner of course.

Come in any serving BiB who has done the Met Accident Investigation Course by Mathematics.
Tell them what stopping difference from lock up of a ten tonner and a Mini is.
Ignore brake compensators

With great deference and respect to your age and experience DVD, (and mine come to that!), if you carry out these tests with today's wagons the results are spectacularly different for two reasons: ABS and modern tyres.
What I will give you is that the worst stopping distances I have seen are UNLADEN white van, Transit, Merc Sprinter, etc.
All over the road and usually sideways at that!!
I'm not so sure about a ten tonner, but some of the 7.5 tonners are disgracefully put together and are just oversize box vans with grossly inadequate tyre area and braking capability.
When you go into the real big stuff it's an entirely different ball game.

I find that a little hard to believe. completely untrue.

To match the contact area loading of my car a 32 tonne truck would need 22 times the contact area. That means each wheel on the truck (assuming it has six axles) would need four times the contact area of the car wheel.
And that's before you take into account having to avoid jackknifing.
