Traffic wardens parking on double yellow lines
Discussion
So, this morning I get to work, shoe-horn the car into (limited) on-street parking and start the short
walk to the office. Spot two council mopeds scooting about, traffic wardens (both on L plates, which I
think should be outlawed, I don't think a company is looking after the H+S of it's staff allowing them to
ride on L's, but that's another matter!).
They then park up on double yellows, hop off and start having a chat, tucked in behind a lorry.
So, long story short...out comes my phone cam! Pictures to be posted later. Unfortunately the faces
aren't clear, but the number plates / bikes are, and the yellow lines. I took a couple quite close, and
a few further away. They got all stroppy, turned away and then one took out a camera and started
snapping me.
I want to know,
1) Are they allowed to photograph pedestrians? (Pervy bar-stewards!)
2) Other than sticking them on here, what to do with the pics? I think that I'll send them to the
council, along with my complaint about them parking illegally (regular occurence there).
Tigger.

In a perfect world we wouldn't have the need for DYL's.
In a near perfect world we wouldn't have the need for the Traffic Regulation Order to exempt Parking attendants from stopping their vehicles on a DYL whilst they do the job.
In an almost perfect world the LA would accept that parking as above sets a bad example if it could be done otherwise and accept a complaint with photos from MOP when done and castigate those responsible.
In a shitty world said Attendants armed with likely complainants mug shot will post it up in the canteen and have the whole bunch on a manhunt to issue a ticket everytime said person seen.

DVD - any idea where I would stand with a complaint about them photographing me? THey had no reason to, I didn't approach them, didn't speak to them and certainly don't look very menacing?
Not fussed if they try to ticket me, they'll never find me doing anything they can ticket me for.
Oh well, I'll settle for posting the pics on here tonight.

I assume that if they begin hunting you down then I would be looking to take a harassment case out against them. They can take pics of you in a public place however, as you consent by being out in public essentially.
If they are standing chatting (ideally you have a pic of them eating or whatever) then they can't claim to be "working"
I am also unclear as to why, if Yellow Lines are there for a reason, that the Traffic Wardens have an exemption?

Contat them and ask for details of why and how they are holding images of you under the Data Protection Act. and what protection they have for not abusing what they hold on you.
Without (some) link to the individual, the photographs themselves do not fall under the DPA - StreakyThanks for that Tigger, you've really made my morning! I had a real good chuckle when I read this thread!
I just love it how, knowing that they've dropped a b*ll*ck by getting photographed, they took a picture of you to get their own back! Classic! What are these guys, 12 years old?
Yellow lines mean no parking, but you are allowed to stop. But by dismounting, it counts as parking, so they should get their asses nailed to the wall. Problem is they recruit jobsworths for traffic warden duties these days, a little power goes to their heads and they're too dumb to avoid getting into trouble.
But on the plus side it gives the rest of us some stress-relief!

I know they can process personal data for "governmental procedures" or some such guff, but I don't think a pedestrian photographing council workers who he believes aren't working is doing anything that warrants a pic taken for legal reasons.
I will email the council at lunch and ask them about it.
Does anyone know about the L plate thing? Is it ok for them to ride on L's?
I doubt the photo was a legal thing, they're just trying to p*ss you off.
They can ride upto 125cc bikes on 'L' plates provided that they have a provisional licence and have completed CBT (Compulsory Basic Training). They must also be insured, for business use, and as a provisional licence holder.
But no, it's not very ethical to have you employees using a motor vehicle without full training, as the spirit of the law is to allow you to learn without accompanyment, not to intensively use the roads at peak times without ever having had a test.

Oh give over. Its a public place and anyone can take piccies of anything. Its not like they photocopied his council tax bill.

So, you're complaining about them taking photos of you - just after you've taken photos of them ?

That always bugs me as well. Nearly as much as the tow truck double parking in rush hour to lift a car parked on a part-time restriction; the traffic would flow much better if they just left it where it was!
But then we know its actually about the money - the only reason most of the LA's opted for the council-run parking enforcement schemes

Snodog - urmmm, yes. I took a picture of COUNCIL STAFF who I believed to be doing something wrong. (Namely skiving, whilst parking on double yellows - there were zero illegally parked vehicles in that area). The one who took pictures of me had no such valid reason as far as I can tell. As a council employee, using council equipment (to photograph me) - I think I'm entitled to question why he took a photo, and remind the council of their duties to process this data in accordance with the DPA. Now, unless they're passing my picture onto the police (eek, what if they say I threatened them...hmmmmm...hopefully my office CCTV covers that road! I didn't go within 20 yards of them btw.) I see no valid reason for them snapping me.
Why do you think they shouldn't take photos of you? If you weren't doing anything wrong, which the photos would provide evidence of, then nothing to worry about.
How many times may you have been unwittingly incuded on tourists' photos? You have to right not to be photographed, though you could avoid it by hiding in bed all day.

I only thing I would be concerned about is the potential misuse of that photograph.
The picture of me was taken using council property (digi' camera), was not work related, and as such is probably a breach of their rules somewhere along the lines.
As the photo was taken (effectively) by the countil, I *do* have a right not to be photographed like that - it's called the "Data Protection Act"...and seems to be very clear that photographs are personal information and should be processed according to the rules, rules which suggest they have sod all reason to photograph me other than for mishief or nuisance / harrasment. I photographed them because of an apparent breach of rules of the road which I'll be complaining about to the council.

Anyone can photograph you in public. You are in public.. That is the point of it. The photographing of you is not an issue, DPA does not cover your face when it is in public, but "sensitive" personal information.
www.hmso.gov.uk I think will show you.
BUT< if suddenly each time you got out of the car an attendent materialised, I would be looking at taking the matter up as harassment, you can prosecute privately remember..
